ORDINANCE FOR ThE ANNEXATION OF REAL ESTATE
TO THE VILLAGE OF COLFAX

WHEREAS, there has been filed with the Clerk of the Village of Colfax, McLean County, Illinois, a petition In writing and under oath by the record owner of certain real estate as therein described, and
WHEREAS, the petition prays that said tract of land be annexed to the Village of Colfax, Illinois and
WHEREAS, legal notices regarding the intention of the Village to annex said territory have been sent to all public bodies required to receive said notice by State Statute, and
WHEREAS, an affidavit of said notices has been signed and recorded In the Office of the Recorder of Deeds, McLean County, Illinois, and
WHEREAS, it appears that said tract is not within the Corporate limits of any municipality, but said tract is contiguous to the Village of Colfäx, Illinois, and that no electors reside thereon, and
WHEREAS the legal owner of record of said property and the Village of Colfax have entered into a valid and binding Annexation Agreement relating to said property, and
WHEREAS, all Petitioner's documents and other necessary legal requirements are in full compliance with the tern's of the Annexation Agreement and with the States of the State of Illinois, specifically Section 7-1-8 of the Illinois Municipal Code, 65 ILCS 5 and
WHEREAS, it is in the best interests of the Village of Colfax that the territory be annexed thereto;
NOW, THEREFORE, be it ordained by the Board of Trustees of the Village of Colfax, McLean County, Illinois;
1) That the following described property all In McLean County, Illinois, to-Wit
the South 35.72 acres except the East 10 acres thereof, of the Southeast Quarter (SE ¼) of the Southeast Quarter (SE%) of Section 3, Township 24 North, Range S East of the Third Principal Meridian, and except Lot 1 in Homey Subdivision in the South Half (S½) of the Southeast Quarter (SE'4) of Section 3, Township 24 North, Range 5 East of the Third Principal Meridian, according to the Plat thereof recorded September 28, 1984, as Document No. 84-12173, McLean County, Illinois, and also one-half of all roadways bordering said property,

be, and the same is hereby annexed to the Village of Colfax, McLean County I and said entire tract of real estateso shown on said plat hereby made a part of said village;
2) That this ordinance shall be in full force and effect from and after its date of passage,
3) That the Village Clerk of the Village of ColfaX be and hereby is authorized and directed to file a certified copy of this ordinance together with an accurate plat of said annexed territory in the office of the Recorder of Deeds for McLean county Illinois as provided in Sections 7-1-8 and 7-1-10, of Chapter 24, Illinois Revised Statutes.

ORDINANCE FOR THE INVOLUNTARY ANNEXATION OF REAL ESTATE
TO THE VILLAGE OF COLFAX
WHEREAS, the Village of Colfax, McLean County, Illinois, has annexed certain properties Into the Village. and
WHEREAS, the Village of Colfax now entirety surrounds property described below, and
WHEREAS, legal notices regarding the intention of the Village to annex said territory have been sent to all public bodies and individual landowners required to receive said notice by State Statute, and
WHEREAS, an affidavit of said notices has been signed and recorded in the Office of the Recorder of Deeds, McLean County, Illinois, and
WHEREAS, it appears that said tract is not within the Corporate limits of any municipality, but said tract is entirely surrounded by the Village of Colfax, Illinois, and
WHEREAS, it is in the best interests of the Village of Colfax that the territory be annexed thereto;
NOW, THEREFORE, be it ordained by the Board of Trustees of the Village of Colftx, McLean County, Illinois;
1) That the following described property all in McLean County, Illinois, to-wit:
Lots 9, 10, 11, 12, 13, 14, 15, 16, 17, 18, 19 In Bradford's Subdivision of the North 5.75 acres of the South East 1/4 of the South East 1 of Section 3, Township 24 North, Range 5 East of the Third Principal Meridian, In MCLEAN COUNTY, ILLINOIS, and also one-half of all roadways bordering the property,

be, and the same is hereby annexed to the Village of Colfax, McLean County, Illinois, and said entire tract of real estate so shown on said plat be hereby made a part of said village;

2) That this ordinance shall be in full force and effect from and after its date of passage;

PRE-ANNEXATION AGREEMENT

THIS AGREEMENT is made and entered into by and between the VILLAGE OF COLFAX, McLean County, Illinois, hereinafter referred to as ‘VILLAGE, and JOSEPH KEELEY and JAMES McKEON, hereinafter referred to as PETITIONERS."
RECITALS:
1. The PETITIONERS are the record legal title holders and owners of record of the premises described in Exhibit A attached hereto and by reference made a part hereof.
2. The premises described in Exhibit A attached hereto is not within the corporate limits of any municipality, but is contiguous to the VILLAGE.
3. The PETITIONERS are desirous of having said premises annexed to the VILLAGE, and the VILLAGE is desirous of annexing said premises. Accordingly, the PETITIONERS have given or will give all notices required by Chapter 24, Section 7-1-1 of the Illinois Revised Statutes, for the purposes of annexation prior to action by the VILLAGE.
AGREEMENT
I. ZONING. Upon Annexation to the VILLAGE as provided in this agreement, the VILLAGE agrees to re-zone said premises as described in the Exhibit A from Agricultural Classification pursuant to the County zoning laws to that of Multi-Family Residential Zoning
District pursuant to the VILLAGE'S zoning code.
II. PLAN. The PETIONERS contemplate developing the subject premises as required under existing Multi-Family Residential Zoning Regulations.
III. SANiTARY SEWER. The VILLAGE agrees to provide sanitary sewer to the property of sufficient size to service approximately four (4) lots and six (6) households.
1V. WATER. The VILLAGE agrees to provide water service to the property of sufficient size to service ap four (4) lots and six (6) households.

V. ZONING COMPLIANCE. The PETITIONERS, in the use and development of the property, will comply with all applicable zoning and subdivision building codesas in effect on the date of this Agreement, unless further variance is granted by the VILLAGE.
VI. APPLICABILiTY. This Agreement and all terms and conditions contacted herin shall be binding on all parties signatory hereto, the successors and assigns and upon the designated corporate authorities and their successors in office and shall remain in effect and enforceable for a period of five (5) years from date of passage of the annexation ordinance contemplated by this Agreement.

EXHIBIT A
Lot 20 in Bradford's Subdivision of the North 5.75 acres of the South East 1/4 of the South East 1/4 of Section 3, Township 24 North, Range 5 East of the Third Principal Meridian, in McLEAN COUNTY, Illinois.

PRE-ANNEXATION AGREEMENT
- THIS AGREEMENT is made and entered into by and between the VILLAGE OF COLFAX, McLean County, Illinois, hereinafter referred to as ‘VILLAGE," and OCTAVIA MANOR, INC., hereinafter referred to as "MANOR."
RECITALS
1. The MANOR is the record legal title holder and owner of record of the premises described in Exhibit A, attached hereto and by reference made a part hereof.
2. The premises described in Exhibit A attached hereto is not within the corporate limits of any municipality, but is contiguous to the VILLAGE.
3. The MANOR is desirous of having said premises annexed to the VILLAGE, and the VILLAGE is desirous of annexing said premises. Accordingly, the MANOR has given or will give all notices required by Chapter 24, Section 7 of the Illinois Revised Statutes, for the purposes of annexation prior to action by the VILLAGE.
AGREEMENT
I. ZONING. Upon Annexation to the VILLAGE as provided in this agreement, the VILLAGE agrees to re-zone said premises as described in the Exhibit A from Agricultuial Classification pursuant to the County zoning laws to that of R-Residential Zoning District pursuant to the VILLAGE'S zoning code: Excepting the following - The VILLAGE agrees to rezone the East 150 Feet of the North 930 Feet of the subject property to multi-family residential.
II. PLAN. The MANOR contemplates developing the subject premises substantially as depicted on the Subdivision Plan, a copy of which is attached hereto and made a part hereof as Exhibit B. The VILLAGE agrees to approve the Final Subdivision Plat showing the lot arrangement as depicted on the Subdivision Plan if it is in substantial accord with the Plan attached hereto as Exhibit B which provides all lot dimensions, streets, utility locations, and easement dedications. Said subdivision shall be known as "OCTAVIA MANOR" Subdivision, and each lot contained herein shall have a lot area of not less than 10,000 square feet in the area.
ifi. ROAD WIDTH. The MANOR shall dedicate sixty (60) feet of right-of-way for a road as required by the subdivision ordinances of the VILLAGE.
IV. ROADWAYS. The MANOR agrees to install a street base of not less than 7 inches in accordance with Village subdivision requirements. The VILLAGE agrees to finish the roadway with a durable hard surface.
V. SANiTARY SEWER. The VILLAGE agrees to install sanitary sewer of sufficient size to service approximately thirty (30) lots as shown on Exhibit B.
VI. STORM SEWERS. The VILLAGE will not require the installation of storm sewers, but will require the MANOR to grade and ditch the property to effect adequate drainage.
VII. CURB AND GUTTERS. The VILLAGE will not require the installation of curbs or gutters, but will require the MANOR to grade and ditch the property to effect adequate drainage.
VIII. WATER. The VILLAGE agrees to install six inch (6") public water mains, as shown on the Final Subdivision Plat to the subject premises.

IX. ENGINEERiNG FEES. The VILLAGE will retain an engineering firm for services relating to sanitary sewers, water, and other utilities, and will be responsible for all fees in connection with those services. The MANOR will retain an engineering firm for services relating to plat development, grading, streets, and other require not provided by the VILLAGE'S engineer.
X. ZONING COMPLIANCE. Except as provided in this Agreement, the MANOR, in the use and development of the property, will comply with all applicable zoning, subdivision, building and codes as in effect on the date of this Agreement, unless further variance is granted by the VILLAGE.
XI. APPLICABILITY. This Agreement and all terms and conditions contained herein shall be binding on all parties signatory herelo, their successors and assigns and upon the designated corporate authorities and their successors in office and shall remain in effect and enforceable for a period of five (5) years from date of passage of the annexation ordinance contemplated by this Agreement.

ORDINANCE #1991
WAGE ORDINANCE
WHEREAS, the State of Illinois has enacted "An ACT regulating wages of laborers, mechanics and other workmen employed in any public works by the State, county, city or any public body or any political subdivision or by any one under contract for public works, "approved June 26, 1941, as amended, being Section. 39s-1 through 39s-12, Chapter 48, Illinois Revised Statues, 1989 and
WHEREAS, the aforesaid Act requires that the President of the Village of Colf ax investigate and ascertain the prevailing rate of wages as defined in said Act for laborers, mechanics and other workmen in the locality of said Village of Colfax employed in performing construction of public works, for said village of Colf ax exclusive of maintenance work,
NOW THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF VILLAGE OF COLFAX:
SECTION 1: To the extent and as required by "An Act regulating wages of laborers, mechanics and other workmen employed in any public works by the State, county, city or any public body or any political subdivision or by any one under contract for public works, approved June 26, 1941, as amended, the general prevailing rate of wages in this locality for laborers, mechanics and other workmen engaged in the construction of public works coming under the jurisdiction of this Village of Colfax is hereby ascertained to be the same as the prevailing rate of wages for construction work in McLean County area as determined by the Department of Labor of the State of Illinois as of June 1991 a copy of that determination being attached hereto and incorporated herein by reference. The definition of any tens appearing in this Ordinance which are also used in aforesaid Act shall be the same as in said Act.
SECTION 2: Nothing herein contained shall be construed to apply said general prevailing rate of wages as herein ascertained to any work or employment except public works construction of this Village of Colfax to the extent required by the aforesaid Act.
SECTION 3: The Village Clerk shall publicly post or keep available for inspection by any interested party in the main office of this Village of Colfax this determination of such prevailing rate of wage.
SECTION 4: The Village Clerk shall mail a copy of this determination to any employer, and to any association of employers and to any person or association of employees who have filed, or file their names and addresses, requesting copies of any determination stating the particular rates and the particular class of workmen whose wages will be affected by such rates.
SECTION 5: The Village Clerk shall cause to be published in a newspaper of general circulation within the area a copy of this ordinance, and such publication shall constitute notice that the determination is effective and that this is the determination of this public body.
