AN ORDINANCE AMENDING ORDINANCE NO. 2006-3
AN ORDINANCE BANNING THE BURNING OF LANDSCAPE WASTE
WITHIN THE VILLAGE OF COLFAX
WHEREAS, the Mayor and the Board of Trustees of the Village of Colfax have reconsidered the total banning of the burning of the landscape waste within the Village of Colfax as set forth in Ordinance 2006-3 and have determined that a reduction in the burning of landscape waste within the Village of Colfax by limiting the days and times for such burning is in the best interest of the Village of Colfax and will still be a benefit promoting the health and safety of its citizens: and
WHEREAS, the Mayor and the Board of Trustees of the Village of Colfax have reconsidered that regulated burning of landscape waste by residents of the Village of Colfax should be allowed only between the hours of 8:00 a.m. and 12 noon, on the 1st and 3rd Saturdays of each month as outlined in Ordinance No. 2006-3 should be amended to permit burning of landscape waste on each Saturday only between the hours of 10:00 a.m. and 5:00 p.m except when the Saturday falls on a holiday weekend.
WHEREAS, the Mayor and Board of Trustees of the Village of Colfax have determined that it is a matter of urgency that this ordinance be made effective immediately for the health and safety of its citizens.
Be It Ordained by the Mayor and the Board of Trustees of the Village of Colfax, McLean County, Illinois as follows:
Section 1: Amendment of Section 3 Ordinance 2006-3. That Section 3 of Ordinance No. 2006-3 (An Ordinance Banning the Burning of Landscape Waste) is hereby amended by adding the following provision thereto:
Γ’β¬Εe. Burning by residents on the Saturday of each week between the hours of 10:00 a.m. and 5:00 p.m. except when the Saturday falls on a holiday weekend. The terms and provisions of this Ordinance shall not apply to any burning of landscape waste on the Saturday of each week between the hours of 10:00 a.m. and 5:00 p.m. except when the Saturday falls on a holiday weekend, provided that such burning is otherwise in accordance with Ordinance No. 2006-03, as amended and is also in accordance with all other local, county, and state regulations, ordinances and lawsΓ’β¬Β
Section 2. Full Force and Effect of Ordinance No. 2006-03 Except as amended Section 1 above, Ordinance No. 2020-07 as passed and approved and published on June 1, 2020 shall remain in full force and effect.
Section 3. Severability. If any provision of this Ordinance, or the application of any provision of this Ordinance, is held unconstitutional or otherwise invalid, such occurrence shall not affect other provisions of this Ordinance, or their application, that can be given effect without the unconstitutional or invalid provision, or application of such provision, is severable, unless otherwise provided by this Ordinance.
Section 4 Effective Date. That this Ordinance, due to urgency, shall be in full force and effect from and after its passage and approval, in booklet (pamphlet) form, according to the laws of the State of Illinois.
