The regular monthly meeting of the Village Board of Colfax was called to order on Monday evening, April 1, 2013 at 7:00 p.m. by Mayor Ricardo Onken.

Trustees present were: Rick Vance - Aye; David Rathke - Aye; Jason Pierce - Aye; Carol Stephenson - Aye; Lonnie Meiner - Aye; Rick Wagoner - Aye.

Also present were Village Treasurer Linda Hanson, Village Attorney Tom Shields, Police Chief Michael Scott, and Superintendent Damon Getty.

Trustee Carol Stephenson made a motion to dispense with the reading of the minutes and approve as presented. Trustee David Rathke seconded the motion. Vote: Rick Vance - Aye; David Rathke; Jason Pierce - Aye; Carol Stephenson - Aye; Lonnie Meiner - Aye; Rick Wagoner - Aye; Motion carried.

Village Treasurer Linda Hanson gave the Treasurer's Report for the month of March, 2013.
Beginning Balance as of 03/01/2013 $177,061.76
Ending Balance as of 03/31/2013 $173,574.28
Decrease for month of March, 2013 ($ 3,487.48)

Trustee Rick Vance made a motion to pay the bills as presented. Trustee Lonnie Meiner seconded the motion. Vote: Rick Vance - Aye; David Rathke - Aye; Jason Pierce - Aye; Carol Stephenson - Aye; Lonnie Meiner - Aye; Rick Wagoner - Aye; Motion carried.

Trustee Lonnie Meiner, Chairman of the Finance and Audit Committee, reported that he has nothing to report tonight and he will call a Finance Committee meeting within the next week or two to go over the budget and discuss salary increases. Lonnie stated if we have to have a special meeting then we will call that.

Mayor Ricardo Onken asked about evaluations and whose has been done. Trustee David Rathke reported that the Police Department is done. Trustee Rick Wagoner reported that the Public Works Department is done.

Village Clerk Nancy Kiper reported receiving a paper in today's mail regarding a lien and the party did not show up for the arbitration hearing.

Trustee David Rathke, Chairman of the Police and Liquor Committee, reported on the Police Committee meeting that was held at 6:00 p.m. on April 1, 2013. Dave also reported that the Activity Report for the month of March, 2013 is in your folders.

Police Chief Mike Scott gave an update on the inspection of the building at 112-114 East Main Street. Mike reported that Engineer Mike Friend of Andrews Engineering went with him to inspect the building.

Mike reported getting in contact with the owner of the building, Todd Clark who told Mike to get ahold of the realtor. Mike spoke and met with the realtor. Mike reported that there are some pictures about the condition of the building and a copy of Mike Friend's report on the condition of the building. Mike did report that he just found out today that someone reported that Scott Tongate bought the building and is going to redo the building and open a woodworking shop in there. Mike will continue to see what happens there and if nothing is done will issue Ordinance Violations and see if we can get Mr. Clark's attention.

Mike also reported receiving a telephone call from Tonia Anderson, Village Clerk with the Village of Cooksville. Mike reported that Cooksville might be interested in contracting with the Police Department for patrol and for enforcing the Village ordinances since the County will not enforce any ordinances. Mike stated that he briefly talked about it in the Police Committee meeting and did a proposal without adding any extra personnel or putting a strain on taking care of the Village of Colfax.

Mike reported that he contacted Michelle Noel regarding the burned out trailer at 401 South Oak Street. M
Trustee Rick Wagoner, Chairman of the Water and Sewer Committee, reported that Damon hasn't received the information back on the well. Rick wants to get more information before reporting to the Board and making a decision on this.

Rick reported that Damon found another contact for meters. He was possibly trying to return the meters we have now and get credit for them because will be getting the same type of meter at $40.00 less per meter.

Rick reported that he spoke with Richard Alwood regarding adjusting his pay rate now that Damon has his license. He doesn't have a problem with readjusting the pay rate on the water. Right now the Village pays him $200.00 per month for using his water license. Rick stated that Richard also doesn't have a problem if the Village wants to keep him on as a retainer if Damon has any questions regarding the water because he will be here monthly anyway for the sewer. This would be on an hourly rate - probably around $35.00 per hour.

Rick reported that the Water and Sewer Committee did Damon's evaluation and will get that to the Finance and Audit Committee for review.

Trustee Carol Stephenson, Chairman of the Streets and Lights Committee, reported that the speed bump that was purchased and put down on Pool Drive is torn up. n Carol stated what do we have to do to replace it. Damon stated we will replace it. Though that was to be taken up for the winter.n Carol stated that bolts are sticking out of the pavement. Damon reported that he got all of those out.

Carol reported to Mike that some of the Memorial Markers in the park are bent over too. Mike stated that he has seven (7) community service kids coming in so it will be taken care of.

Damon has been doing some cold patching.

The meeting moved to new business to give Andy Tull owner of Ridgeview Recycling a chance to address the Board regarding the contract which is due to expire on April 30, 2013 with the Village.

Andy Tull asked what it would take for Ridgeview Recycling to put a proposal in too since the board went outside of town. Andy stated, "I don't know what I am up against and didn't know anything about it until customers brought it to me." Village Clerk Nancy Kiper will get ahold of Dan Winters of Allied Waste amd see of we can vote next month. Ric Onken asked Andy if he has something in mind. Said the main issue was money. Andy asked why it hasn't been billed through the water. Mayor Ric Onken stated because not everyone takes advantage of this and can't bill everyone who doesn't used the recycling. Andy asked how are you doing this with Allied? Rick Wagoner stated because it is broken down water, sewer, garbage, and drainage. Allied is going to physically bring out a container for every household and if you use it fine and if you don't fine. if they do not use it they will have to contact us and will pick the container up and bring it back here. The bill will be adjusted if they don't do the Allied Recycling. They will pickup once a month and will adjust that to twice a month if they need to. Everything will go in on container.

Resident Dona Clark asked if the town as a whole didn't have any input in it. They weren't asked to give their opinion. Rick Wagoner stated they are more than happy to come to the meetings.

Ric Onken stated that if we knew who utilizes the Ridgeview Recycling facility could get an idea from that for charging. Do not know who utilizes from inside the Village limits. It is for the whole Ridgeview area.

There are two sizes of containers available. If the households do not want the larger container Allied will bring a smaller one out for that resident.

Andy stated he hadn't planned on raising his rates at all. Ric asked if there is any way he could get an idea who from the Village brings stuff in. Andy stated probably twenty-five to thirty percent (25-30%) of the people living in town here. Most of this board recycles.

Andy stated it has ben eighteen years this month.

Trustee Lonnie Meiner asked if Andy has any other ideas of going about it and cheaper for the Village and still keep you in business. Andy would have to think about it. Lonnie stated we are giving you $5,000.00 per year plus we are paying for people outside of Colfax to use this. Lonnie stated that with Allied people that will be using this will be paying for their own not the Village paying for it.

Ric Onken stated if twenty-five to thirty percent (25-30%) of the people of the Village use this that would be roughly 300 people and if we could get names of these people and bill them on their water bills. Not the same people use this every time and some people drop their recycling off during the week so don't know who they are. It would be hard to know who all comes through.

Andy suggested that the Board contact Gibson City - they sell passes to the residents in order to use the recycling program there. Nancy will contact the City of Gibson City and check into this.

Lonnie Meiner asked if we want to invite Andy back to next meeting unless they come up with something beforehand.

Will table this until the May 6th board meeting.

The first item on Old Business was regarding the tree that needs removed at 209 East Cooper Street. This tree sits over the water shutoff for the property. Mayor Ric Onken asked if anyone got a chance to look at the tree. Trustee Lonnie Meiner stated it's the Village'a tree isn't it. Why does it have to be taken down? Damon stated that it would cost $800 - $1,000 to cut down from Becker Tree Service. Damon reported that Donnie Meiner, owner of the property, will replace the sidewalk. The Board is wondering if there was another option for this. Damon stated he has it capped out in the middle of the yard now but it's wet there.

The next item on the agenda was an update regarding the CIRBN. Trustee David Rathke stated that he hasn't heard anything else since the last meeting. Asked if anyone had shown up - Village Clerk Nancy Kiper reported it is all in and ready.

Mayor Ric Onken reported that the 2013-14 Ordinance Appropriation Budget to be voted on. Trustee Lonnie Meiner wants this tabled until next month to review at Finance Committee meeting.

Next on the agenda was to approve Ordinance #2013-01 to put a stop sign up at the Orchard Street and South Grove Street intersection.

Trustee Rick Vance made a motion to approve Ordinance #2013-01 as drafted. Trustee Jason Pierce seconded the motion. Vote: Rick Vance - Aye; David Rathke - Aye; Jason Pierce - Aye; Carol Stephenson - Aye; Lonnie Meiner - Aye; Rick Wagoner - Aye; Motion carried.

Last on the agenda was the contract with Allied Waste for garbage and/or recycling services. Table until next month.

Mayor Ric Onken addressed the Board regarding Public Works Department. Ric feels that the Board needs to see about hiring a second person with both their water and sewer licenses. Ric stated that Richard is planning on retiring to Florida in the fall.
