The regular monthly meeting of the Village Board of Colfax was called to order on Monday evening, May 7, 2012 by Mayor Ricardo Onken.

Trustees present were:  Rick Vance - Aye; Jason Pierce - Aye; Carol Stephenson - Aye; Lonnie Meiner - Aye; Rick Wagoner - Aye;

Trustee David Rathke was absent.

Also present were Village Treasurer Linda Hanson; Village Attorney Tom Shields; Police Chief Michael Scott; Superintendent Damon Getty; Assistant Superintendent David Hinrichsen.

Trustee Rick Vance made a motion to dispense with the reading of the minutes and approve as presented.  Trustee Jason Pierce seconded the motion.  Vote:  Rick Vance - Aye; David Rathke - Absent; Jason Pierce - Aye; Carol Stephenson - Aye; Lonnie Meiner - Aye; Rick Wagoner - Aye; Motion carried.

Village Treasurer Linda Hanson gave the Treasurer's Report for the month of April, 2012.  Beginning balance as of 04/01/12  -  $101,650.57; Ending balance as of 04/30/12  -  $98,636.11; Decrease for the month of April, 2012  -  ($3,014.46).

Trustee Lonnie Meiner made a motion to pay the bills as presented.  Trustee Carol Stephenson seconded the motion.  Vote:  Rick Vance - Aye; David Rathke - Absent; Jason Pierce - Aye; Carol Stephenson - Aye; Lonnie Meiner - Aye; Rick Wagoner - Aye; Motion carried.

Trustee Carol Stephenson made a motion to close Fiscal year 2011-2012.  Trustee Lonnie Meiner seconded the motion.  Vote:  Rick Vance - Aye; David Rathke - Absent; Jason Pierce - Aye; Carol Stephenson - Aye; Lonnie Meiner - Aye; Rick Wagoner - Aye; Motion carried.

Chairman of the Finance and Audit Committee, Trustee Lonnie Meiner reported on the Finance Committee meeting held on Thursday, May 3rd for the evaluation of Village Clerk Nancy Kiper.  Lonnie also reported that himself and Trustee Jason Pierce discussed salaries.  Lonnie stated they both felt like the Board needs to look at the overtime and changing the pay schedule.  As it stands looks like everyone will get a two percent (2%) increase but need to get a better handle on the overtime.  Need to have a closed session to discuss this some more.

Village Clerk Nancy Kiper reported that the auditor will be here May 31st and June 1st.

Police and Liquor Committee Chairman David Rathke was absent.  In his absence Police Chief Mike Scott reported on the Police Department activities for the month.  Mike reported that the hours and activities are on your report.

Mike reported that the perpetrator for the driveway blacktopping scam is in custody and the grand jury indicted him for aggravated home repair fraud and a warrant was issued.  U S Marshall's office located him in sourthern Illinois and he is currently waiting in McLean County Jail for trial.

Mike reported on the solicitor's ordinance.  Mike stated he had a conversation with the Chief in Hudson and they have added a couple of things that I thought were really interesting and we should consider.  They require them to have some sort of badge - which we could reproduce easily on the computer and it also has their picture and Nancy could put her seal on so that they would have to show when they go to the houses and people would know that they have checked in at the Village.  The second thing that Hudson does is offer a "No Solicitors" sticker.  If the residents come and get these stickers and you post "No Soliciting" by the Village it is illegal for anyone to solicit at your residence and can issue ordinance violation.

Carol asked about insurance salesmen.  Mike stated they would have to come down to  -  unless they called ahead and made an appointment with the residents.  If they are going on cold calls then they would need to have this badge and a permit.

Rick Wagoner asked how many solicitors do you think we get?  Mike stated we are getting very few in here but if we can get the word out that they have to have this.

We can talk about this some more in the Committee.

The Part Time Police Officer Ordinance needs to be update.  Mike received a letter from the State Training Board and they have a couple of issues with our ordinance.  Mike reported printing off a copy of the letter, our ordinance and a copy of their sample ordinance.

Mike reported that DOC came by - about once every three years they come through and do an inspection - we don't have a jail so it's not a long inspection.  They talk to us about how we handle juveniles and that leads to a conversation about our Community Service Program.  Talked to them about that for a while and he was pretty impressed and asked if he could refer people to us.

Mike stated that took advantage of a situation where the fire department had a company called Ragan Communications doing their re-banding of radios.  Mike reported that he talked to the guy and said while you are here.  Anyway he did all of the re-bandable radios for $22.00 apiece.  Supreme Radio was going to charge $65.00 plus a service call.

Next, Mike asked if the Board wants to put a speed bump on Pool Drive.  Rick Wagoner asked if we talked about a temporary one.  Mike stated they range from $150.00 to $400.00,.  Mike stated we need a ten foot (10') one which will be about $300.00.

Mike reported on the UCR reports that are required to be sent into the State each month.  This is the crime stats that state requires us to send.  The State has made cuts but they will no longer accept faxes.  In order to send these online you have to have a Static IP Address.  Mike reported that he spoke with Kelly Gordon and he is going to help Mike get this set up.

Trustee Rick Wagoner asked again about the Speed Bump.  Mike said there were quite a few complaints last year.  Trustee Lonnie Meiner asked Damon if you could build a speed bump.  Said it wouldn't be any cheaper.

Trustee Rick Wagoner made a motion to have Mike Scott purchase a speed bump with a price not to exceed $300.00 excluding shipping.  Trustee Lonnie Meiner seconded the motion.  Vote:  Rick Vance - Aye; David Rathke - Absent; Jason Pierce - Aye; Carol Stephenson - Aye; Lonnie Meiner - Aye; Rick Wagoner - Aye; Motion carried.

Chairman of the Water and Sewer Committee, Trustee Rick Wagoner reported on the Water and Sewer Committee meeting.

Rick asked Superintendent Damon Getty if he heard any more from Steve at the EPA.  Rick reported that Damon was going to start a more regular water flushing.

Rick also reported that the Ordinance for new taps - changing it to a "present charge" instead of a fixed rate so that we don't have to keep changing the price as the costs increase.

Rick asked if we got the new meters in from Water Products.

Chairman of the Streets and Lights Committee, Trustee Carol Stephenson reported she was asked if the Village could replace the sidewalk down by Zelma Schleeter's at the corner of Cooper and Center Streets.  Carol stated it is really bad.  Ric Onken asked if we have any sidewalk funding for this year.  Trustee Lonnie Meiner asked Mike Scott what is going on with the Sidewalk Grant Program.  Mike stated we are waiting on the next funding cycle.

Carol asked doesn't our ordinance state that the homeowner pay for fifty percent (50%) and the Village pays the fifty percent (50%).  Damon stated if the homeowner requests it yes.  Carol stated you might want to take a look at that area.  Ric Onken stated there is a sidewalk across the street from us in front of that house and it is all broken up - might as well be taken out.

Trustee Lonnie Meiner proposed to do so many blocks of sidewalks a year.  Carol stated they get put on the back burner every year.  Rick Wagoner stated we can see what we can spend and go from there.

The first item under old business is for the Budget Appropriation Ordinance.

Village Clerk Nancy Kiper stated that she didn't change anything from the draft that was given last month.  The only thing that should change is the Garbage - our new rate is a four percent (4%) increase and what is on the draft is a five percent (5%) increase.

Trustee Rick Wagoner made a motion to approve the 2012-13 Budget Appropriation Ordinance.  Trustee Lonnie Meiner seconded the motion.  Vote:  Rick Vance - Aye; David Rathke - Absent; Jason Pierce - Aye; Carol Stephenson - Aye; Lonnie Meiner - Aye; Rick Wagoner - Aye; Motion carried.

Village Attorney Tom Shields explained the Water Ordinance to change the water meter testing charge.

Trustee Rick Wagoner made a motion to approve Ordinance #2012-01 as drafted.  Trustee Jason Pierce seconded the motion.  Vote:  Rick Vance - Aye; David Rathke - Absent; Jason Pierce - Aye; Carol Stephenson - Aye; Lonnie Meiner - Aye; Rick Wagoner - Aye; Motion carried.

Village Clerk Nancy Kiper explained that Andrews Engineer helped finalize the 2011-12 MFT.  They went through all of the invoices and prepared the paper work and sent it into IDOT.

Trustee Rick Vance made a motion to close the 2011-12 Motor Fuel Tax Fiscal Year.  Trustee Lonnie Meiner seconded the motion.  Vote:  Rick Vance - Aye; David Rathke - Absent; Jason Pierce - Aye; Carol Stephenson - Aye; Lonnie Meiner - Aye; Rick Wagoner - Aye; Motion carried.

The first item under new business was regarding recycling.  Dan Winters from Allied Waste was to be here but he called and his boss didn't get all of the information put together that he needed for curbside recycling.  Table until next month.

Ric explained the Amendment to the Collocation Agreement that is in your folders.  This is just additional information for the first amendment.  Ric stated that this is just that we are allowing them to use the tower to mount the equipment.  There have been no blueprints sent to tell us how they are going to mount this or anything.  If we approve this we will add to it pending that they give us blueprints on how they are going to mount this and pending our engineer's ok.

Trustee Jason Pierce made a motion to close the regular session meeting and to go into closed session to consider the appointment, employment,compensation, discipline, performance, or dismissal of all employees listed on the agenda.  Trustee Rick Wagoner seconded the motion.  Vote:  Rick Vance - Aye; David Rathke - Absent; Jason Pierce - Aye; Carol Stephenson - Aye; Lonnie Meiner - Aye; Rick Wagoner - Aye; Motion carried.

Mayor Ric Onken asked the committees to explain about the evaluations for their particular committees.

Trustee Lonnie Meiner explained the evaluation for Village Clerk Nancy Kiper and her goals and performance.

Trustee Jason Pierce explained the evaluation for the Police Department.  Everyone on the Police Committee thinks Mike is an extremely valuable asset to the community.  Gave him excellents across the Board and that we are very lucky to have him.  Some of the goals are expressed in trying to find proactive ways to improve things without costing the Village money.  Try to keep seeking those other sources out and keep budget in line - which it looks like he has been doing a really good job of too.  The committee talked about five percent (5%) for part-time officers too.

Mayor Ric Onken stated that he had asked the Street Committee to evaluate David Hinrichsen but didn't realize that they didn't have that much interaction with you.  Damon did an evaluation for you but I also want an evaluation from some of the Board members.  I talked to Rick and Lonnie but he just said he hadn't had a chance to do that yet.  I am requesting that they do that for next meeting.  Table that until next meeting and if there is an increase it will be retroactive.

Ric also explained about Damon Getty's evaluation.  The same type of situation and the Board is looking at some different things.  There has been a committee appointed to meet with you and go over a couple of things and there are some questions and some ideas.  Table that until next meeting and if there is an increase it will be retroactive.

Ric stated as far as the increased if you want to look at that.  They are requesting five percent (5%) for the police and two percent (2%) for Nancy if you want to look at that in with Dave's and Damon's then have a vote on that next month.  Any increases would be retroactive to this month.

Mayor Ricardo Onken announced the following appointments for the 2012-13 fiscal year with the advice and consent of the Board.

Trustee Carol Stephenson made a motion to appoint Linda Hanson as Village Treasurer for the 2012-13 fiscal year.  Trustee Lonnie Meiner seconded the motion.  Vote:  Rick Vance - Aye; David Rathke - Absent; Jason Pierce - Aye; Carol Stephenson - Aye; Lonnie Meiner - Aye; Rick Wagoner - Aye; Motion carried.

Trustee Jason Pierce made a motion to appoint Nancy Kiper as Village Clerk for the 2012-13 fiscal year.  Trustee Carol Stephenson seconded the motion.  Vote:  Rick Vance - Aye; David Rathke - Absent; Jason Pierce - Aye; Carol Stephenson - Aye; Lonnie Meiner - Aye; Rick Wagoner - Aye; Motion carried.

Trustee Jason Pierce made a motion to appoint Ritchie Cooper; Robert Brandt; Josh Saathoff; Michael Lay; and Damon Getty as part time police officer for the 2012-13 fiscal year.  Trustee Rick Vance seconded the motion.  Vote:  Rick Vance - Aye; David Rathke - Absent; Jason Pierce - Aye; Carol Stephenson - Aye; Lonnie Meiner - Aye; Rick Wagoner - Aye; Motion carried.

Trustee Jason Pierce made a motion to appoint David Hinrichsen as Zoning Officer and Nancy Kiper as Assistant Zoning Officer for the 2012-13 fiscal year.  Trustee Carol Stephenson seconded the motion.  Vote:  Rick Vance - Aye; David Rathke - Absent; Jason Pierce - Aye; Carol Stephenson - Aye; Lonnie Meiner - Aye; Rick Wagoner - Aye; Motion carried.

Trustee Carol Stephenson made a motion to appoint Andrews Engineering as Village Engineer on an as needed basis for the 2012-13 fiscal year.  Trustee Rick Vance seconded the motion.  Vote:  Rick Vance - Aye; David Rathke - Absent; Jason Pierce - Aye; Carol Stephenson - Aye; Lonnie Meiner - Aye; Rick Wagoner - Aye; Motion carried.

Trustee Lonnie Meiner made a motion to appoint Brent Blair as Animal Control Officer for the 2012-13 fiscal year.  Trustee Carol Stephenson seconded the motion.  Vote:  Rick Vance - Aye; David Rathke - Absent; Jason Pierce - Aye; Carol Stephenson - Aye; Lonnie Meiner - Aye; Rick Wagoner - Aye; Motion carried.

Ric Onken stated that the committees will stay the same.  Jason Pierce will be the committee head for the new committee.
