�� The regular monthly meeting of the Village Board of Colfax was called to order on Monday�evening,�May 2, 2011 at 7:00 p.m. by Mayor Ricardo Onken.
�� Trustees present were:� Donna Poppe - Aye; David Rathke - Aye; Carol Stephenson - Aye; Lonnie Meiner - Aye; Rick Wagoner - Aye;� Bruce Green was absent.
�� Also present were Village Attorney Tom Shields; Village Treasurer Linda Hanson; Police Chief Mike Scott; Superintendent Damon Getty.

�� Village Treasurer Linda Hanson gave the Treasurer's Report for the month of April, 2011.� Beginning Balance as of 04/01/11�� -�� $64,600.78;� Ending Balance as of 04/20/11�� -�� $63,719.86; Decrease in April, 2011� -�($ 880.92).� $1,000.00 was paid on the loan at Peoples State Bank of Colfax.

�� Village Clerk Nancy Kiper stated that we need to canvas the votes for the recent Consolildated Election held on April 4, 2011.� Nancy reported receiving the canvas from the McLean County Clerk's office.���� Lonnie Meiner� -� 83 votes;� Jason Pierce� -� 23 votes.
�� With the Advice and Consent of the Board, Mayor Ricardo Onken would like to appoint Rick Vance to the Village Board to fill the vacancy.

� Mayor Ric Onken handed out the new papers with the Committees for the new 2011-12 fiscal year.
�� Chairman of the Finance and Audit Committee, Trustee Lonnie Meiner reported that he spoke with David Dodson at Peoples State Bank of Colfax regarding the Sewer Project.� Lonnie stated that he took the information that Village Attorney Tom Shields had given us regarding municipal borrowing.� Lonnie reported that Dave would like to have a more businesslike situation as far as reports, payments or interest so that the Village would have a more set payment of at least the interest on the repayment.
�� Village Clerk Nancy Kiper reported that Lawrence Travis will be here on June 13th and 14th to do the audit.
�� Trustee David Rathke, Chairman of the Police and Liquor Committee, reported on the activities of the Police Department for the month of April.
�� Dave reported that he and Mike met and that evaluations were done for the Police Department.� Dave reported no problems with any of the employees.� Dave stated that they talked about how the Police Department and the school district are cooperating.� Making sure that we don't have any incidents and to proatively stop any of that stuff.
�� Trustee Rick Wagoner asked if they still have a closed campus at lunch.� Mike reported that there is still a closed campus and students must stay at school during lunch hour.
�� Village Clerk Nancy Kiper stated that all of the new liquor licenses were renewed before their Saturday, April 30, 2011 expiration date.� Trustee Rick Wagoner asked how many licenses we have - there are five.
�� Trustee Rick Wagoner, Chairman of the Water and Sewer Committee, reported that Damon has a list of the new meters that he will be needing.� He would like to order two (2) cases of each.� Damon stated that we can order just one or two cases at a time now - there is no minimum order.
�� Rick Wagoner asked Damon if the new control panel has been installed yet - they had to order the program for this and are waiting for it to come in.
�� Damon reported that the permit for the Sewer Project is under review at the EPA.� Will know more in a couple of weeks.
�� Rick Wagoner gave the new trustees an update on the upgrade that will be done to the sewer.� Rick stated that the project is sort of on hold until we get the permit from the EPA.
�� Chairman of the Streets and Lights Committee, Trustee Carol Stephenson and Superintendent Damon Getty explained about the tile problem on East Fifer Street which caused a huge water problem in the residents' yard.� Damon explained that new tile had been installed which took care of the water problem.� Carol commended Damon and Dave for taking care of this problem.
�� Dave Rathke stated Mike has a draft of the sign for the Veterans.� He handed out an estimate of cost to the Board.
�� The first item of Old Business was the Franchise Agreement with Mediacom.� Village Attorney Tom Shields explained the agreement to the Board.� The highlight is that we are increasing our percentage from one percent (1%) to five percent (5%).
�� Trustee Rick Wagoner made a motion to approve the Franchise Agreement between the Village of Colfax and Mediacom and to authorize the Mayor to sign the agreement.� Trustee Lonnie Meiner seconded the motion.� Vote:� Rick Vance - Aye; David Rathke - Aye; Jason Pierce�- Aye; Carol Stephenson - Aye; Lonnie Meiner - aye; Rick Wagoner - Aye; Motion carried.
�� Village Attorney Tom Shields explained the Final Lease Agreement between U S Cellular and the Village of Colfax to the Board.� Tom explained that the Village has agreed to lease the 50 X 50 foot area to U S Cellular and includes the payment to the Village for moving the gas line and cable lines.� The monthly amount to the Village will be $650.00.
�� Trustee David Rathke made a motion to approve the Final Lease between U S Cellular and the Village of Colfax and to authorize the Mayor to sign the agreement.� Trustee Rick Wagoner seconded the motion.� Vote:� Rick Vance - Aye; David Rathke - Aye; Jason Pierce - Aye; Carol Stephenson - Aye; Lonnie Meiner - Aye; Rick Wagoner - Aye; Motion carried.
�� Village Attorney Tom Shields explained to the Board the changes made to the Water Ordinance.� There have been changes to the security deposit and the reconnection fee.� Trustee Rick Wagoner asked about the three year item - do they have to be fine free for three years�for that to roll over.� Village Attorney Tom Shields explained that the courts are going to look for something like this if�it is challenged in that there has�to be some opportunity for this person to restore to good standing again and back�to the $100.00 deposit.� Village�Clerk Nancy Kiper reported that there were eighty-eight (88) people who did not pay their water/sewer bill last month.� Tom stated that the Village cannot put this into affect until July's water bill.

�� The first item of New Business was regarding AJ & Katrina Kirkpatrick's purchase of the A W Building.� Mayor Ric Onken explained their plans for the building and that they have already contacted the EPA and everyone necessary to contact regarding licenses and permits.� Wants to open up a body shop and repair shop and hopes to build up business to tear this old building down and build a new building.
�� The next item was renewal of the recycling contract with Ridgeview Recycling.� The Board is still wondering about whether the Village should pay owner Andy Tull to pickup whites (appliances, etc.) since there is another party in town that has been doing this without charge to the Village.� The Board would like to approve the recycling part of the contract but would like to wait until next month for the whites part of the contract.
�� Trustee Rick Wagoner made a motion to approve the Recycling program only for Ridgeview Recycling at a cost of $425.00 per month.� Trustee Lonnie Meiner seconded the motion.� Vote:� Rick Vance - Aye; David Rathke - Aye; Jason Pierce - Aye; Carol Stephenson - Aye; Lonnie Meiner - Aye; Rick Wagoner - Aye; Motion carried.
�� Table the "Whites" part of the contract until next month.
�� Mayor Ric Onken reported talking to Dan Winters at Allied Waste regarding the recycling program that they had previously wanted to setup in the Village.� The cost would be $1.30 to $2.00 per household.� He would need to know how many were interested before we could start.� He would need a three year contract but can't do that because the Mayor only has two years left on his term of office.� Ric stated that Lexington has already started this program and they all like it.
�� Village Clerk Nancy Kiper reported that the new garbage rates for the new year is $11.90 which is only up forty-six cents (46) from last year.� With the price of gas so high was a little surprised that there was this little of increase.
�� Ric reported that in February had a meeting with a few of the businesses here in town.� Some people mentioned about having a cleanup day.� Ric spoke to Allied Waste to see what the cost of this would be.� There are two options:� 1.� Put a dumpster in a couple places in town but Damon and Dave would have to go around and pickup all of the stuff and put in the boxes.� 2.� Allied Waste would send trucks out and pickup the stuff - this would be on a Saturday and would cost the Village $3,525.00.
� Damon asked if that isn't the reason why we raised the garbage rates and that they will pick this stuff up every week if peoploe put it out.� They are still not going to take construction materials; btteries; tires or anything during clean-up.
�� Some people do not do this because they do not want to bring it up to the drop off point but if they have it in their homes more people would be likely to recycle.
�� Mayor Ric Onken stated we have a letter from the Showbus thanking the Village for their donations.
�� The Village has another agreement with CIBRN.� Ric stated he just received this and that Tom has not had a chance to look this over yet.� Ric also reported that it has to be turned in by the 16th of the month.� We will have to have a special meeting in order to approve this.� Mayor Ric Onken set up a special meeting for Monday evening, May 9th at 6:30 p.m.� The only thing on the agenda will be the CIBRN agreement.
�� Ric spoke with Lee Klintworth regarding the school building next door.� We would be interested in the building but Chad Hoffman wants to talk to the Committee first.
�� Tom Ales was here to talk about picking up whites.� Village Attorney Tom Shields stated this needs to be on the agenda for next month.
�� Village Clerk Nancy Kiper explained about the Illinois Municiple League calculations on the impact to municipalities if they cut the income tax.
