���� The regular monthly meeting of the Village Board of Colfax was called to order at 7:00 p.m. on Monday evening, February 7, 2011 by Mayor Ricardo Onken.

���� Trustees present were: Donna Poppe - Aye; Carol Stephenson - Aye; Lonnie Meiner - Aye; Rick Wagoner - Aye;

���� Trustees David Rathke and Bruce Green were absent.

���� Also present were: Village Treasurer Linda Hanson; Village Attorney Tom Shields; Police Chief Michael Scott; Superintendent Damon Getty.

���� Trustee Donna Poppe made a motion to dispense with the reading of the minutes and approve as presented. Trustee Carol Stephenson seconded the motion. Vote: Donna Poppe - Aye; David Rathke - Absent; Bruce Green - Absent; Carol Stephenson - Aye; Lonnie Meiner - Aye; Rick Wagoner - Aye; Motion carried.

���� Village Treasurer Linda Hanson gave the Treasurer's Report for the month of January, 2011. Beginning Balance as of 01/01/11 $39,776.73; Ending Balance as of 01/31/11 $50,204.99; Increase for January, 2011 $10,428.26;

���� Linda reported that $1,300.96 was paid at Peoples State Bank of Colfax on the loan - owe $14,000.00.

���� Trustee Lonnie Meiner made a motion to pay the bills as presented. Trustee Donna Poppe seconded the motion. Vote: Donna Poppe - Aye; Daivd Rathke - Absent; Bruce Green - Absent;� Carol Stephenson - Aye; Lonnie Meiner - Aye; Rick Wagoner - Aye; Motion carried.

���� Trustee Lonnie Meiner, Chairman of the Finance and Audit Committee, had nothing to report except that Nancy paid $1,300.96 on the loan at the Bank.

���� Village Clerk Nancy Kiper reported that this is the first month in almost two years that the State paid everything they are suppose to pay to the Village.

���� Trustee Rick Wagoner, Chairman of the Water and Sewer Committee, asked Mayor Ric Onken if he had an update on the Grant.� Ric explained where we are with the grant.� They are needing some information and some pictures.� Ric stated he tried to contact Ed Duran but he was in class.� As soon as they get that information in there it sounds like we will be getting the money and can get started on the project.

���� Rick explained that at the Committee meeting it was discussed about adjusting the fees for after water is shut off.� Rick explained that we are at the point of not re-cooping the debt that we have for the water bills.� Rick explained that the Committee would like to add an additional fee/deposit because the $100.00 that most of the people have on deposit does not cover the bills when they get shut off.� There would have to be an ordinance change in order to do this.

���� Superintendent Damon Getty reported that the well has been fixed.� Superintendent Damon Getty showed the Board a portion of the pipe from Well #4.� Damon said something is eating away at the pipes in the well.� This was used pipe that was out of the old well when this well was dug.� Albrecht's said that every three to four years we are going to have to pull that and put new pipe in.� Rick will try to have the numbers together of what it costs to pull that well each time and what the costs of stainless pipe would be.

���� Rick Wagoner set a Water/Sewer Committee meeting for Monday evening, March 7th at 6:00 p.m. before the regular monthly meeting.

���� Chairman of the Police and Liquor Committee, Trustee David Rathke was absent but Police Chief Michael Scott gave the report on the activities for the month of January for the Police Department.

���� Mike also asked the Board if anyone had any questions on the "Needs Assement" report that he had given to them last month.

���� Superintendent Damon Getty presented a quote from Hereford Construction for a new roof on the Sterets Shed.� Will probably get another quote before deciding this spring to put the new roof on.� Mayor Ric Onken stated he spoke with Gail Ritchie and there is a material you can put up as a temporary fix until spring.

���� First on the agenda under new business was the Franchise Agreement between the Village of Colfax and Mediacom.� Village Attorney Tom Shields explained that the Village can increase the percentage rate up to five percent (5%).� The Board would like to see them add some toll free telephone numbers so that we are able to contact them if needed.� Ric reported that the last agreement was on 1996.� The percentage is all based on the annual gross revenue.� Tom stated that the original agreement is with Triax - that's how far back it goes.� Tom explained some changes that he feels needs to be put into this agreement.

���� Damon asked if there was anything in the agreement about them burying the cables.� Tom will look and see if there is something we can put in about this.

���� Table this until next month's meeting.

���� Next on the agenda was Greg Riblet and some of the other residents - Jim Weber and John Nagy from Sunset Drive.� Mr. Riblet addressed the Board regarding the problem with the flooding and sewer backups.� Mr. Riblet would like for the Village to turn this into the Village's insurance and see what they will do about paying this cleanup bill.�

���� Mayor Ric Onken asked Mr. Riblet how many houses out there have this problem.� Greg told him he knows of four (4).� Rick asked Damon why this is hooked into the sewer line.� A friend of Mr. Riblet's suggested an overhead sewer.� Mayor Ric Onken asked who did the hookups at the houses when the houses were built.

���� Greg Riblet stated that Isaacson's Construction did his; Tolan Excavating did Jim Weber's and Bart Rigsby did John Nagy's.� Mr,. Riblet stated they had a backflow valve installed last year.� Rick Wagoner asked if the company that installed the backflow valve recommended a maintenance schedule.� Greg said yes twice a year and he has done that.� He stated that last year the backflow valve worked and did it's job.� Greg knows that no one could see this coming.� Donna asked what caused this - Damon said it was a sewer line clogged up down by the lift station.� Ric asked if this is an illegal hookup.� Damon said no it is footing tiled outside.� The Riblets have roughed in a� bathroom in the basement sot he pipes are there but it is not hooked up yet.

���� Greg asked if the village will contribute to putting an overhead sewer in his house.� There are four (4) houses in their neighborhood that has this problem.� These residents are wondering if the Village would go 50/50 for the overhead sewer project.� Ric would like to talk to our engineer regarding this and see what he says.� Rick Wagoner asked about maybe if these homes need to have a manual shut-off besides the backflow valve just as a precaution.� Greg stated that's fine except you have to be home in order to use that and if they are at work or gone wouldn't keep this from happening.

���� Trustee Rick Wagoner made a motion to discontinue the Random Drug/Alcohol Testing Program.� Trustee Carol Stephenson seconded the motion.� Vote:� Donna Poppe - Aye; David Rathke - Absent; Bruce Green - Absent; Carol Stephenson - Aye; Lonnie Meiner - Aye; Rick Wagoner - Aye; Motion carried.

���� Colfax resident Jim Weber asked about the drainage tile between the houses.� Superintendent Damon Getty stated the Village will not do anything about�it� that's the homeowner's issue.� Damon stated that they can put some kind of barricade over it.

���� Trustee Lonnie Meiner made a motion to adjourn.� Trustee Rick Wagoner seconded the motion.� Vote:� Donna Poppe - Aye; David Rathke - Absent; Bruce Green - Absent; Carol Stephenson - Aye; Lonnie Meiner - Aye; Rick Wagoner - Aye; Motion carried.
