CHAPTER 41
TRAFFIC
41.01 STATE TRAFFIC LAWS ADOPTED. (a) The Illinois Vehicle Code is hereby adopted and made a part of this chapter by reference and shall be applicable in the village.
(b) Any person who violates any provision of the Illinois Vehicle Code within the village shall be subject to the penalty provided for violation of this code. (ref. IRS Ch. 95-1 /2, sec. 20-204)
41.02 SPEED LIMITS. When signs are erected giving notice thereof, no person shall drive a vehicle in excess of the following indicated speed limits on any of the following streets:
Main Street in business district, 20 miles per hour.
All other streets, 30 miles per hour. (am. 2/14/91)
41. 03 RECKLESS, NEGLIGANT OR CARELESS DRIVING. It shall be unlawful to operate any vehicle in the village in a careless, reckless, negligent or wanton manner, or carelessly so as to endanger life or property.
41. 04 U-TURNS. No person operating a vehicle upon any street in the village designated as a through street shall make a U-turn any place on such street, except at intersections.
41.05 THROUGH STREETS AND STOP INTERSECTIONS. The streets and intersections described in Schedule A attached hereto and made a part hereof are hereby designated through streets and stop intersections and four-way stop intersections as described in such schedule. Where stop signs are erected in accordance with such schedule at the entrances to the through streets and stop intersections the operator of a vehicle approaching a stop sign shall stop as required by law.
41.06 YIELD INTERSECTIONS. The intersections described in Sched ule B are hereby designated as yield intersections as described in such schedule. Where yield signs are erected in accordance with such schedule at the entrances to the yield intersections the operator of a vehicle approaching a yield sign shall reduce speed and yield the right of way as required by law.

WHEREAS, the President and the Board of Trustees of the Village of Colfax have reviewed Section 41.03, Schedule A of Chapter 41 of the Municipal Code Village of Colfax, McLean County, Illinois which states as follows:

And have determined that said stop intersections be rescinded and replaced with the following provision:

41.07 LIGHTS ON PARKED VEHICLES. Whenever a vehicle is parked or stopped on a street during the times between one-half hour after sunset and one-half hour before sunrise or at any other time when there is not sufficient light to render clearly discernible any vehicle on the street from a distance of zoo feet, there shall be displayed upon such vehicle one or more lamps projecting a white light visible under normal atmospheric conditions from a distance of 500 feet to the front of such vehicle and projecting a red light visible under like conditions from a distance of 500 feet to the rear, except that such parking light or lights need not be displayed upon any vehicle stopped or parked in accordance with other provisions of this chapter upon any street designated by the Chief of Police where there is sufficient light to reveal any person within a distance of 200 feet upon such street
41.08 PARKING VEHICLES FOR SALE. It shall be unlawful to park any vehicle upon any street for the purpose of displaying it for sale or to park any vehicle upon any street from which vehicle merchandise is peddled, or to park any vehicle upon any street without state license plates upon it, issued for such vehicle, to the owner of the vehicle, in ac cordance with the Illinois Revised Statutes.
41. 09 LOADING ZONES. The Chief of Police may determine the location of loading zones and shall erect or maintain or cause to be erected or maintained appropriate signs indicating the same. It shall be unlawful to stop, stand or park a vehicle for a period of time longer than necessary for the unloading and delivery or pick-up of materials in any place marked as a loading zone.
41. 10 PARKING PROHIBITED. When signs are erected in each block giving notice thereof, no person shall park a vehicle at such places and during the times designated in Schedule C attached to and made a part hereof.
41.11 LIMITED PARKING. When signs are erected in a block giving notice thereof, no person shall park a vehicle for longer than the time designated within the district or upon any of the streets described in Sched ule D attached to and made a part hereof.
41. 12 TOWING AWAY VEHICLES. The Police Department is hereby authorized to have removed and towed away any car or other vehicle illegally parked in any place where such parked vehicle creates or constitutes a traffic hazard, blocks the use of a fire hydrant or obstructs or may obstruct the movement of any emergency vehicle; or in any public place where signs have been legally posted either limiting or prohibiting parking; or any vehicle.

Schedule C - Parking Prohibited
a. On the South side of Cooper Street for the distance of 20 feet West from the Southwest corner of Cooper and Harrison Street.
b. On the East side of Center Street from the alley between Main Street and North Street to the intersection with Route 165.

which has been parked in any public street, public parking lot, or other public place for a period of 24 consecutive hours. Cars towed away shall be stored and shall be released to the owner or operator thereof after payment of the expense incurred in removing and storing such vehicles.
41. 13 ALL NIGHT PARKING. When signs are erected at the entrances
of highways into the village giving notice thereof, no person shall park a vehicle for longer than 30 minutes between the hours of 2:00 a. in. and 6:00
a. in. on any day, except physicians on calls.
41. 14 ANGLE PARKING. Parking shall be at an angle, as marked, on Main Street and on Center Street.
41. 15 PARKING ON PRIVATE PROPERTY. It shall be unlawful to park any motor vehicle on any private property without the consent of the owner of the property.
41.16 PARKING IN ALLEYS. No person shall park a vehicle within an alley except for the purpose of loading and unloading merchandise and then in such a manner or under such conditions as to leave available less than 10 feet of the width of the roadway for the free movement of vehicular traffic, and no person shall stop, stand or park a vehicle within an alley in such a position as to block the driveway entrance to any abutting property.
41. 17 RESPONSIBILITY OF OWNER. The fact that a vehicle is registered in a person's name shall be prima facie proof that such person was responsible for any violation of any parking regulation of this chapter in volving such vehicle.
41. 18 BICYCLES AND MOTORCYCLES. No person shall operate or ride on a bicycle or motorcycle on any street unless all persons thereon are riding on a seat, permanently attached to the vehicle.
41.19 CLINGING TO MOVING VEHICLES. Any person riding upon any bicycle, motorcycle, coaster, sled, roller skates, or any toy vehicle shall not attach the same or himself to any moving vehicle upon any roadway. No person shall ride on the running board, fender, or outside step of any vehicle.
41.20 USE OF COASTERS, ROLLER SKATES AND SIMILAR DEVICES.
No person upon roller skates, or riding in or by means of any coaster, toy vehicle, or similar device shall go upon any roadway except while cràssing a street on a crosswalk and except upon streets set aside as play streets when and as authorized by ordinance.
41. 21 SPILLING LOADS. No vehicle shall be so loaded that any part of its load spills or drops on any street or alley.

41.22 SNOWMOBILES. The snowmobile path through the Village of Colfax is hereby abolished and all ordinances regulating the flow of snowmobiles are hereby repealed except as follows:
(a) it shall be illegal to operate a snowmobile within the vilage limits of the Village of Colfax, McLean County, illinois except as allowed by statutes of the State of Illinois.

41.01 STATE TRAFFIC LAWS ADOPTED. (a) The Illinois Vehicle Code is hereby adopted and made a part of this chapter by reference and shall be applicable in the village.
(b) Any person who violates any provision of the Illinois Vehicle Code within the village shall be subject to the penalty provided for violation of this code. (ref. IRS Ch. 95-1 /2, sec. 20-204)
41.02 SPEED LIMITS. When signs are erected giving notice thereof, no person shall drive a vehicle in excess of the following indicated speed limits on any of the following streets:
Main Street in business district, 20 miles per hour.
All other streets, 30 miles per hour. (am. 2/14/91)
41. 03 RECKLESS, NEGLIGANT OR CARELESS DRIVING. It shall be unlawful to operate any vehicle in the village in a careless, reckless, negligent or wanton manner, or carelessly so as to endanger life or property.
41. 04 U-TURNS. No person operating a vehicle upon any street in the village designated as a through street shall make a U-turn any place on such street, except at intersections.
41.05 THROUGH STREETS AND STOP INTERSECTIONS. The streets and intersections described in Schedule A attached hereto and made a part hereof are hereby designated through streets and stop intersections and four-way stop intersections as described in such schedule. Where stop signs are erected in accordance with such schedule at the entrances to the through streets and stop intersections the operator of a vehicle approaching a stop sign shall stop as required by law.
41.06 YIELD INTERSECTIONS. The intersections described in Sched ule B are hereby designated as yield intersections as described in such schedule. Where yield signs are erected in accordance with such schedule at the entrances to the yield intersections the operator of a vehicle approaching a yield sign shall reduce speed and yield the right of way as required by law.

41.07 LIGHTS ON PARKED VEHICLES. Whenever a vehicle is parked or stopped on a street during the times between one-half hour after sunset and one-half hour before sunrise or at any other time when there is not sufficient light to render clearly discernible any vehicle on the street from a distance of zoo feet, there shall be displayed upon such vehicle one or more lamps projecting a white light visible under normal atmospheric conditions from a distance of 500 feet to the front of such vehicle and projecting a red light visible under like conditions from a distance of 500 feet to the rear, except that such parking light or lights need not be displayed upon any vehicle stopped or parked in accordance with other provisions of this chapter upon any street designated by the Chief of Police where there is sufficient light to reveal any person within a distance of 200 feet upon such street
41.08 PARKING VEHICLES FOR SALE. It shall be unlawful to park any vehicle upon any street for the purpose of displaying it for sale or to park any vehicle upon any street from which vehicle merchandise is peddled, or to park any vehicle upon any street without state license plates upon it, issued for such vehicle, to the owner of the vehicle, in ac cordance with the Illinois Revised Statutes.
41. 09 LOADING ZONES. The Chief of Police may determine the location of loading zones and shall erect or maintain or cause to be erected or maintained appropriate signs indicating the same. It shall be unlawful to stop, stand or park a vehicle for a period of time longer than necessary for the unloading and delivery or pick-up of materials in any place marked as a loading zone.
41. 10 PARKING PROHIBITED. When signs are erected in each block giving notice thereof, no person shall park a vehicle at such places and during the times designated in Schedule C attached to and made a part hereof.
41.11 LIMITED PARKING. When signs are erected in a block giving notice thereof, no person shall park a vehicle for longer than the time designated within the district or upon any of the streets described in Sched ule D attached to and made a part hereof.
41. 12 TOWING AWAY VEHICLES. The Police Department is hereby authorized to have removed and towed away any car or other vehicle illegally parked in any place where such parked vehicle creates or constitutes a traffic hazard, blocks the use of a fire hydrant or obstructs or may obstruct the movement of any emergency vehicle; or in any public place where signs have been legally posted either limiting or prohibiting parking; or any vehicle.

WHEREAS, the President and the Board of Trustees of the Village of Colfax have reviewed Schedule C of Chapter 41 (Traffic), Section 41.10--Parking Prohibited, of the Municipal Code of the Village of Colfax and have determined tht said Schedule C should be rescinde and replaced with a new Schedule C which would prohibit parking as follows: "On the South side of Cooper Street for the distance of 20 feet West from the Southwest corner of Cooper and Harrison Street" and "On the East side of Center Street from the alley between Main Street and North Street to the intersection with Route 165"/
BE IT ORDAINED BY THE PRESIDENT AND THE BOARD OF TRUSTEES OF THE VILLAGE OF COLFAX, ILLINOIS:
SECTION 1. That Schedule C of Chapter 41 (Traffic), Section 41.10--Parking Prohibited, of the Municipal Code of the Village of Colfax is hereby rescinded and replaced with a new Schedule C which shall prohibit parking as follows: "On the South side of Cooper Street for the distance of 20 feet West from the Southwest corner of Cooper and Harrison Street" and "On the East side of Center Street from the alley between Main Street and North Street to the intersection with Route 165". Schedule C - Parking Prohibited
a. On the South side of Cooper Street for the distance of 20 feet West from the Southwest corner of Cooper and Harrison Street.

which has been parked in any public street, public parking lot, or other public place for a period of 24 consecutive hours. Cars towed away shall be stored and shall be released to the owner or operator thereof after payment of the expense incurred in removing and storing such vehicles.
41. 13 ALL NIGHT PARKING. When signs are erected at the entrances
of highways into the village giving notice thereof, no person shall park a vehicle for longer than 30 minutes between the hours of 2:00 a. in. and 6:00
a. in. on any day, except physicians on calls.
41. 14 ANGLE PARKING. Parking shall be at an angle, as marked, on Main Street and on Center Street.
41. 15 PARKING ON PRIVATE PROPERTY. It shall be unlawful to park any motor vehicle on any private property without the consent of the owner of the property.
41.16 PARKING IN ALLEYS. No person shall park a vehicle within an alley except for the purpose of loading and unloading merchandise and then in such a manner or under such conditions as to leave available less than 10 feet of the width of the roadway for the free movement of vehicular traffic, and no person shall stop, stand or park a vehicle within an alley in such a position as to block the driveway entrance to any abutting property.
41. 17 RESPONSIBILITY OF OWNER. The fact that a vehicle is registered in a person's name shall be prima facie proof that such person was responsible for any violation of any parking regulation of this chapter in volving such vehicle.
41. 18 BICYCLES AND MOTORCYCLES. No person shall operate or ride on a bicycle or motorcycle on any street unless all persons thereon are riding on a seat, permanently attached to the vehicle.
41.19 CLINGING TO MOVING VEHICLES. Any person riding upon any bicycle, motorcycle, coaster, sled, roller skates, or any toy vehicle shall not attach the same or himself to any moving vehicle upon any roadway. No person shall ride on the running board, fender, or outside step of any vehicle.
41.20 USE OF COASTERS, ROLLER SKATES AND SIMILAR DEVICES.
No person upon roller skates, or riding in or by means of any coaster, toy vehicle, or similar device shall go upon any roadway except while cràssing a street on a crosswalk and except upon streets set aside as play streets when and as authorized by ordinance.
41. 21 SPILLING LOADS. No vehicle shall be so loaded that any part of its load spills or drops on any street or alley.

41.22 SNOWMOBILES. The snowmobile path through the Village of Colfax is hereby abolished and all ordinances regulating the flow of snowmobiles are hereby repealed except as follows:
(a) it shall be illegal to operate a snowmobile within the vilage limits of the Village of Colfax, McLean County, illinois except as allowed by statutes of the State of Illinois.
