41.23 HANDICAP PARKING. The Village Board of Colfax is hereby authorized to designate from time to time a limited availability of handicap parking areas as the Board decides from time to time and as indicated on Schedule E of Section 23 of Chapter 41 of the Municipal Code of the Village of Colfax, McLean County, Illinois. These parking areas shall be posted with one sign each as "Handicap Parking Only" and anyone found parking or standing for the purpose of loading or unloading passengers or materials may be ticketed for the violation of this Ordinance. Each such violation shall carry a $100.00 fme and such other penalties as may be prescribed by Illinois statute. ORDINANCE 2003-21

AN ORDINANCE RESCINDING AND REPLACING SECTION 23 OF CHAPTER 41 OF THE MUNICIPAL CODE OF THE VILLAGE OF COLFAX, McLEAN COUNTY, ILLINOIS

WHEREAS, it is believed that it is necessary to rescind and replace Section 23 of Chapter 41 of the Colfax Municipal Code of the Village of Colfax, McLean County, Illinois, passed, approved, and published January 5, 1976:
WHEREAS, the President and the Board of Trustees of the Village of Colfax have reviewed Section 23 of Chapter 41 of the Municipal Code Village of Colfax, McLean County, Illinois which states as follows:
HANDICAP PARKING. The Village Board is hereby authorized to designate from time to time a limited availability of handicap parking as the Board decides from time to time and as indicated on Schedule E of Chapter 41. WHEREAS, it is believed that is is necessary to rescind and replace Schedule E of Chapter 41 of the Colfax Municipal Code of the Village of Colfax, McLean County, Illinois, passed, approved, and published January 4, 1976.

WHEREAS, the President and the Board of Trustees of the Village of Colfax have reviewed Schedule E of Chapter 41 of the Municipal Code Village of Colfax, McLean County, Illinois which states as follows:

1. Handicap parking only will be allowed on the North side of Wood Street for the distance of 260 feet West from the North West corner of Wood and Harrison Streets.

And have determined that said Schedule of Handicap Only Parking Locations be rescinded and replaced with the following provisions:

41.23 HANDICAP PARKING, SCHEDULE E.

1. Handicap Parking only will be allowed on the East side of North Center Street, North from the Northeast Corner of East Main Street and North Center Street as indicated by "Handicap Parking Only" sign.

2. Handicap Parking only will be allowed on the West side of North Center Streeet, North from the Northwest Corner of West Main Street and North Center Street as indicated by "Handicap Parking Only" sign.

ONE-WAY STREET ALONG WOOD STREET, BETWEEN BROOK
STREET AND HARRISON STREET. ALONG SAID ONE-WAY
STREET, TRAFFIC SHALL FLOW TO THE EAST ONLY AND

WHEREAS, it is believed that it is necessary to rescind and replace Section 26 of Chapter 41 of the Colfax Municipal Code of the Village of Colfax, McLean County, Illinois, passed, approved, and published January 5, 1976:
WHEREAS, the President and the Board of Trustees of the Village of Colfax have reviewed Section 26 of Chapter 41 of the Municipal Code of the Village of Colfax, McLean County, Illinois which states as follows:
41.26 BICYCLE, SKATEBOARD & ROLLERBLADES ON SIDEWALKS. It shall be unlawful for any person or persons to bicycle, skateboard or rollerbiades upon any public sidewalk in the 100 blocks of East Main Street, West Main Street, North Center Street, and South Center Street in the Village.
And have determined that said Bicycle, Skateboard and Rollerblade Ordinance, Section 26 of Chapter 41 be rescinded and replaced with the following provisions:
41.25 BICYCLES, SKATEBOARDS, AND ROLLERBLADES ON PUBLIC SIDEWALKS. It shall be unlawful for any person(s) to operate a bicycle, a skateboard, or rollerblades upon any of the following public sidewalks in the Village of Colfax, Mclean County, Illinois:
In the Block of East Main Street, either on the North nor the South sides of the Street, from the intersection of Main Street and Center Street, East to the intersection of East Main Street and North/South Brook Street;

41.26 REGULATING GOLF CARTS
SECTION 1. No person shall, after the effective date of this Ordinance,
operate any golf cart on the roadways within the Village of Colfax, McLean County, Illinois unless such golf cart has been registered with the Village of Colfax and a permit issued in accordance with the provisions of this Ordinance, and the permit displayed on the Golf Cart.
SECTION 2. The Owner of each golf cart requiring a permit by this Ordinance shall file an application with the Village Clerk on forms provided by the Clerk. The application shall be signed by the Owner of the Golf Cart and shall be accompanied by a $50.00 annual registration fee. The Owner must also show adequate documentation that the person for whose benefit the Golf Cart is to be used (the "authorized user") has a Class IA or 2A disability under the provisions of Section 4A of the Illinois Identification Card Act. For purposes of this Section, an Illinois Disabled Person Identification Card issued pursuant to the Illinois Identification Card Act indicating that the person thereon has a Class 1A or 2A disability shall be adequate documentation of such disability. The Owner of such identification card shall be deemed the "authorized user" for purposes of this Ordinance.
SECTION 3. All golf carts operating in the Village of Colfax pursuant to this Ordinance shall meet or exceed the standards set forth in Illinois P.A. 90-853, as amended (copy attached hereto) and must be affixed with an orange flag as approved by the Chief of Police of the Village of Colfax, McLean County, Illinois.
SECTION 4. Upon receipt of the approved application and upon verification by the Chief of Police of the Village of Colfax that the Golf Cart meets or exceeds the Standards of Section 3 herein, the Village Clerk shall enter the same upon the records of its office and issue to the applicant a permit to be displayed in the Golf Cart in accordance with this Ordinance.
SECTION 5. Possession of a permit shall entitle the "authorized user" ONLY to operate the Golf Cart on the roadways of the Village of Colfax under the Village's jurisdiction. No passengers other than the "authorized user" shall be allowed on the Golf Cart while in operation on Village of Colfax roadways.
SECTION 6. To be eligible, the Owner and the "Authorized User' must be at least eighteen (18) years of age, must possess a valid Illinois driver's license, and must carry the minimum liability insurance pursuant to State Law. The Owner must have a separate permit for each golf cart that he/she owns and intends to operate on Village of Colfax roadways. A permit may not be transferred from one golf cart owned by the Owner, to a new golf cart purchased by the same owner. A permit is nontransferable between two golf carts owned at the same time by one owner. A separate permit must be obtained and displayed in each golf cart owned by the Owner. Upon sale of a Registered Golf Cart, the pennit issued for that golf cart becomes null and void. Upon purchase of a new golf cart, a new permit must be applied fbr issued.
SECTION 7. Should a permit become lost, destroyed, or mutilated beyond legibility, the Owner of the Golf Cart shall make application to the Village Clerk for a replacement permit.

WHEREAS, it is believed that it is necessary to rescind and replace Section 27 of Chapter 41 of the Colfax Municipal Code of the Village of Colfax, McLean County, Illinois, passed, approved, and published January 5, 1976:
WHEREAS, the President and the Board of Trustees of the Village of Colfax have reviewed Section 27 of Chapter 41 of the Municipal Code of the Village of Colfax, McLean County, Illinois which states as follows:
Section 1: No person shall, after the effective date of this Ordinance, operate any golf cart within the Village of Colfax unless such golf cart has been registered and a permit issued in accordance with the provisions of this Ordinance, and the permit displayed on the golf cart.

(1) The crossing is made at an interchange approved by the local unit of government and at a place where no
obstruction prevents a quick and safe crossing; and
(2) The golf cart is brought to a complete stop before attempting a crossing; and
(3) The operator of the golf cart yields the right of way to all pedestrian and vehicular traffic which
constitutes a hazard; and
(4) There is no tunnel or overpass ramp provided. for the golf cart to cross through the golf course.
(c) No person operating a golf cart shall make a direct crossing upon or across any highway under the jurisdiction of the State, tollroad, interstate highway, or controlled access highway in this State.
Cd) For purposes of this Section, "golf cart" means a vehicle specifically designed and intended for the purposes of transporting one or more persons and their golf clubs or maintenance equipment while engaged in the playing of golf, supervising the play of golf, or maintaining the condition of the grounds on a public or private golf course.
Ce) Sub'iect to subsection (b), a municipality. townships county. or other unit of local government may authorize, by ordinance or resolution, the operation of aolf carts on roadways under their respective jurisdictions. The Department may authorize the operation of golf carts on the roadways under its jurisdiction.
Before permitting the operation of golf carts on its roadway a municipal township, county, other unit of local government, or the Department must consider the volume, speed, and character of traffic on the roadway and determine whether golf carts may safely travel on or cross the roadway. Upon determining that golf carts may safely operate on a roadway and the adoption of an ordinance or resolution by a municipality, township, County or other unit of local government, or authorization by the Department. appropriate signs shall be posted.
If a roadway is under the jurisdiction of more than one unit of government, golf carts may not be operated on the roadway unless each unit f government agrees and takes action as provided in this subsection.
No golf cart may be operated on a roadway unless, at a minimum, it has the following: brakes, a steering apparatus, tires, a rearview mirror, red reflectorized wayning devices in the front and rear. a slow movin emblem (as reguired of other vehicles in Section 12-709) on the rear of the golf cart, a headlight that emits a white light visible from a distance of 500 feet to the front. p tail 1am that emits a red light visible from at least 100 feet from the rear, brake lights, and turn signals. When operated on a roadway, a golf cart shall have its headlight and tail lamos lighted s reguired by Section 12-201.
(f) A person who drives or is in actual physical control of a golf cart on a roadway while under the influence is subject to Section 11-500 through 11-502.
