AND WORK OR REPAIRS TO SUCH PROPERTY ON
VILLAGE PROPERTY

ORDINANCE NO. 2017-03

AN ORDINANCE ADDING SECTION 5.18 TO CHAPTER 5 OF THE VILLAGE MUNICIPAL CODE PERTAINING TO PERSONAL PROPERTY AND WORK OR REPAIRS TO SUCH PROPERTY ON VILLAGE PROPERTY

WHEREAS, the Chief of Police of Colfax has reported to the village Board the increase in incidents of Colfax residents obstructing Village streets by leaving personal property on Village right of ways.

WHEREAS, the Village Board feels that for the safety of its residents and to reduce the potential for traffic accidents that it must maintain unobstructed streets, alleys, and sidewalks.

BE IT ORDAINED BY THE VILLAGE BOARD OF THE VILLAGE OF COLFAX, SITUATED IN THE COUNTY OF Mc LEAN AND STATE OF ILLINOIS, as follows:

SECTION 1: Section 5.18 titled “Personal Property” will be added to Chapter 5 of the Village Code and state the following:

A. In addition to the requirements set forth in Section 41.16 of this Code, no responsible party, person, or title owner to personal property shall store, place, collect or stockpile such personal property upon any public right of way or public property. Personal property is to include, but is not limited to, new or used parts of junk vehicles or other machinery unless otherwise permitted by the Village. Personal property shall not include operational vehicles, trailers, trucks, campers or items of personal property specifically allowed under this code or allowed through the approval of the Village through license, resolution, or otherwise. The provisions of Code Section 12.087 in regard to inoperable motor vehicles will remain in full force and effect.

B. No repairing, redesigning, modifying or dismantling work or operations shall be allowed for any vehicle, trailer or parts thereof, or any other operations to any other machinery upon any public right of way or public property. This includes washing, greasing, or other such repairs unless the repairs are necessitated by an emergency.

SECTION 2: Section 5.19 titles “Enforcement” will be added to Chapter 5 of the Village Municipal Code and state the following:

Failure to comply with any provision of this chapter or any parking regulation of this title shall constitute an offense against the Village. The provisions for enforcement and the penalties shall be as follows:

a. The Police Department shall monitor specific violations and cause citations to be issued to violators of this section. The ticket shall be issued to the person in whose name a vehicle is registered and licensed or, otherwise, to the owner of the personal property obstructing Village property.

b. In the event the obstruction Is not moved within seven (7) days, such item shall be either towed at the owner’s expense or shall be confiscated and sold as the Village deems fits. Any storage costs borne by the Village will also be assessed too the violator.

c. This ordinance shall be subject to the penalties set forth in Section 1.06 of the Village Municipal Code.

SECTION 3: This Ordinance shall be in full force and effect from and after its passage, approval and publication as provided by law.

I DO HEREBY CERTIFY that the foregoing attached Ordinance is a full, true and correct copy of Ordinance AN ORDINANCE ADDING SECTION 5.18 TO CHAPTER 5 OF THE VILLAGE MUNICIPAL CODE PERTAINING TO PERSONAL PROPERTY AND WORK OR REPAIRS TO SUCH PROPERTY ON VILLAGE PROPERTY, was duly adopted and passed by the Board of Trustees of said Village at its regularly convened meeting held on the 6th day of November, 2017, and that the Ordinance, as passed, was signed by the mayor of said Village on said day, all as the same appears in the official records of the Village Board of said Village in my care and custody.

I DO FURTHER CERTIFY that a copy of the proposed Ordinance was on file and available for public inspection forty-eight (48) hours before the passage of said Ordinance, and that notice of the subject matter of said Ordinance was place on the agenda for the above Village Board meeting, which was posted and available for public inspection at least forty-eight (48) hours prior to said meeting.

The pamphlet form of Ordinance No. 2017-03, including the Ordinance and a cover sheet thereof, was prepared, and a copy of the Ordinance was posted in the village Hall, commencing on November 6, 2017, and continuing for at least ten days thereafter. Copies of the Ordinance were also available for public inspection upon request in the office of the Village Clerk.
