CHAPTER 3
VILLAGE ADMINISTRATION
3.01 PRESIDENT. (a) Board of Trustees President. The President shall be President of the Board of Trustees as provided by statute. The President may be designated Mayor of the village.
(b) Supervisory Powers. The President shall be the chief executive officer of the village and shall perform all such duties as may be required of him by statute or ordinance. He shall have general supervision over all the executive officers of the village and over all of the employees of the village. He shall have the power and authority to inspect all books and records kept by any village officer or employee at any reasonable time.
(c) Designation of Duties. The President shall settle any question as to the respective powers or duties of any appointed officer or employee of the village. He shall have the power to delegate to any such officer any duty which is to be performed when no specific officer has been directed to perform the duty.
(d) Bond and Oath. Before entering upon the duties of his office the President shall give a surety bond conditioned upon his faithful performance of his duties, in the sum of $3, 000. He shall take the oath of office pre scribed by statute, and shall receive such compensation as may be set from time to time by the board. (ref. IMC 3-14-3)
(e) Appointments. The President shall appoint, by and with the advice and consent of the Board of Trustees, all officers whose appointment is not otherwise provided for by law; and whenever a vacancy occurs in any office, which by law or ordinance he is empowered and required to fill, he shall within 30 days after the happening of such vacancy, communicate to the board the name of his appointee to such office, and pending the concurrence of the board in such appointment, he may designate some suitable person to dis charge the functions of such office. (ref. 1MG 3-8-1)
(f) Removal of Officers. The President shall have the power to remove any officer appointed by him on any formal charge whenever he is of the opinion that the interests of the village demand such removal. He shall re pbrt the reasons for such removal to the board at a meeting to be held not less than five days, nor more than ten days after such removal. If the Presi dent shall fail, or refuse to file with the Clerk a statement of the reasons for such removal or if the board, by a two-thirds vote of all its members author ized by law to be elected, by "yeas" and "nays, " to be entered upon its record, disapprove of such removal, such officer shall thereupon become restored to the office from which he was removed, but he shall give a new bond and take a new oath of office. No officer shall be removed a second time for the same offense. (ref. 1MG 3-11-1)

(g) Licenses. The President shall grant licenses for the purposes authorized by this code to such persons as he may deem proper, unless the board shall otherwise provide, and he may revoke the same for cause.
(h) Signature. The President shall sign all village warrants, com missions, permits and licenses granted by authority of the board, except as otherwise provided, and such other acts and deeds as law or ordinance may require his official signature.
(i) Peace Officer. The President may exercise within the village limits the powers conferred upon sheriffs by law to suppress disorder and keep the peace. (ref. IMC 3-9-4)
(j) President Pro-Term. During the temporary absence or disability of the President, the board shall elect one of its number to act, as President Pro-Tern, who during the absence or disability of the President shall per form the duties of the office. (ref. IMC 3-11-7).
3. 02 CLERK. (b) Oath, Bond. The Clerk before entering upon the duties of his office, shall take the oath of office prescribed by law, and shall execute a bond to the village in the penal sum of $z, 000 or such amount as may be fixed by resolution, with sureties as shall be approved by the President and Board of Trustees, conditioned for the faithful performance of the duties of his office, and the payment of all moneys that may be received by him, accord ing to law and ordinance. The bond shall be filed with the Treasurer.
(c) Office. The Clerk shall keep his office in the village hall or at such other place as the Board of Trustees may direct.
(d) Minutes, Notices. The Clerk shall attend all meetings of the Board of Trustees, and shall keep in a suitable book a full and faithful record of its proceedings. He shall issue and cause to be served upon all trustees notices of all special meetings of the board; also notices to the members of the different committees of the board; and to all other persons whose attendance may be required before any such committee when so directed by the chairman thereof.
(e) Custody of Seal and Records. The Clerk shall be the keeper and custodian of the corporate seal of the village. He shall carefully preserve in his office all books, records, papers, maps and effects of every escrip tion belonging to the village or pertaining to his office, and not in actual use and possession of other village officers. ORDINANCE 2003-26
AN ORDINANCE RESCINDING AND REPLACING
SECTION 3.02(a) OF CHAPTER 3 OF THE
MUNICIPAL CODE OF THE VILLAGE OF COLFAX, Mc LEAN COUNTY, ILLINOIS
WHEREAS, the President and the Board of Trustees of the Village of Colfax have reviewed Section 3.02 of Chapter 3 of the Municipal Code of the Village of Colfax, McLean County, illinois which states as follows:
"3.02 CLERK. (a) Appointment
The President at the first regular meeting in the month of May of each year shall appoint by and with the advice and consent of the Board of Trustees some competent citizen of the Village of Colfax as Clerk for the ensuing fiscal year. (ref. IMC 3-5-9)."
And have determined that said Section 3.02 should be rescinded and replaced with the following provisions:
3.02 VILLAGE CLERK. (a) The President of the Village of Colfax at the first regular meeting in the month of May of each year shall appoint by and with the advice and consent of the Board of Trustees of the Village of Colfax some competent citizen of the Village of Colfax as Village Clerk for the ensuing fiscal year. BE IT ORDAINED BY THE PRESIDENT AND THE BOARD OF TRUSTEES OF THE VILLAGE OF COLFAX OF COLFAX, McLEAN COUNTY, ILLINOIS:
That the Section 3.02 of Chapter 3 of the Municipal Code of the Village of Colfax, McLean County, Illinois which states as follows:

term he shall deliver all such records, books, papers and effects to his successor in office.
(1) Record of Ordinances The Clerk shall record and properly index in a book kept for that purpose, all ordinances passed by the board, within five days after passage and approval by the President, and at the foot of each ordinance so recorded he shall make a memorandum showing dates of passage. (ref. 1MG 1-2-5)
(g) Delivery of Papers to Officers The Clerk shall, without delay, upon the adjournment of each meeting of the board, deliver to the several committees of the board, and to the officers of the city, all petitions, com munications, reports, resolutions, orders, claims and other papers re ferred to those committees or officers by the board. He shall also, without delay, deliver to the President all ordinances or resolutions in his charge. which are required to be approved or otherwise acted upon by the President.
(h) Preparation of Documents The Clerk shall prepare all commis sions, licenses, permits and other official documents required to be issued by him under the laws and ordinances of the village and shall attest the same with the corporate seal; and he shall in like manner attest all deeds for the sale or transfer of real estate owned by the village and all bonds issued by the village.
(i) Purchase of Supplies The Clerk shall, by and with the advice and consent of the board, purchase all necessary office and election supplies.
(j) Record of Licenses. The Clerk shall number in numerical order all licenses made out by him, and before delivery thereof, shall register them in like order in a book kept for that purpose, giving number, date, period of time for which issued, to whom issued, for what purpose, fee, and definite location of business of licensee. He shall also on May I of each year prepare and mail notices for renewal of licenses and payment of fees to the village to all persons engaged in or carrying on a business or occupa tion required to be licensed by this code.
(k) Moneys Received The Clerk shall receive all moüeys due to the village, except tax, special improvement assessments and motor fuel tax refunds, which are paid direct to the Treasurer.
(1) Other Duties In addition to the duties set forth in this section, the Clerk shall perform all other duties pertaining to his office as are and may be imposed upon him by law or resolution of the Board of Trustees.
3. 03 TREASURER. (a) Office Created There is hereby created the office of Treasurer of the village.

(b) Appointment The President, at the first regular meeting in the month of May of each year, shall appoint, by and with the advice and consent of the Board of Trustees, some competent citizen of the village Treasurer for the ensuing fiscal year. (ref. [ 3-8-1)
(c) Oath, Bond The Treasurer, before entering upon the duties of the office, shall take the oath prescribed by law, and shall execute a surety bond to the village, in a penal sum required by statute. (ref. 1MG 3-14-3)
(d) Money, Warrants The Treasurer shall receive all moneys belonging to the village corporation and shall pay all warrants signed by the President and countersigned by the Clerk. He shall keep a separate account of each fund or appropriation, and all the debits and credits belonging thereto. He shall give to every person paying money into the treasury a receipt therefore specifying the date of payment and upon what account paid, and shall file copies of such receipts with the records of the Treasurer's office with the Clerk at the time of making monthly reports of such office.
(e) Register of Warrants The Treasurer shall keep an accurate register of all warrants redeemed and paid, showing the number, date and amount of each, the fund from which paid, and the name of the person to whom and when paid; and shall cancel all warrants as soon as redeemed.
(f) Lost Warrants When any village warrant is lost or destroyed, so that it cannot be presented to the Treasurer for payment by the person entitled thereto, such person shall apply by petition to the Board of Trustees for relief. The board may order the Clerk to issue a duplicate warrant to the person so entitled to payment upon his filing an affidavit of the loss or destruction of the original and giving bond and security to the village to re fund the amount of such warrant and pay all costs in case the original or lost warrant should be presented and the village compelled to pay the same.
(g) Special Assessments All money received by the Treasurer as a special tax or assessment shall be held as a special fund, to be applied to the payment of the improvement for which such special tax or special assessment was made, and the money so received shall be used for no other purpose except to reimburse the village for money expended for such im provement. (ref. 1MG 3-10-6)
(h) Separation of Funds The Treasurer shall keep all moneys in his hands belonging to the village separate and distinct at all times from personal moneys or funds, and he is prohibited from using directly or indirectly the village money or warrants in his custody and keeping for personal use or benefit, or that of any other person. Any violation of this provision shall subject the Treasurer to immediate removal from office by the President and Board of Trustees, who may declare the office vacant and appoint a successor for the unexpired portion of term in manner prescribed for regular appointment. (ref. IMC 3-10-4)

Administration 3. 03
(i) Reports The Treasurer shall prepare for the President and Board of Trustees, as often as required, a full and detailed report of all receipts and expenditures of the corporation, as shown by the books of his office, up to the time of the report. He shall annually between May 1 and May 10 of each year prepare and file with the Clerk a full and detailed report of all receipts and expenditures of all accounts of the office during the preceding fiscal year. The report shall reflect the state of the treasury at the close of the fiscal year. The Clerk shall keep the report on file in his office for the inspection of the general public. (ref. 1MG 3-10-2, 3-10-5)
(j) Delinquent Officers The Treasurer shall report to the President and Board of Trustees any officer authorized to receive money for the use of the village who fails to make a return of the moneys received by him at the time required by law or ordinance.
(k) Accounts The Treasurer shall keep his books and accounts in such manner as to show with accuracy all moneys received and disbursed by him for the village, stating from whom and on what account received, and to whom and what account paid out, and in such way that the books and accounts may be readily investigated and understood. Such books and accounts and all files and papers of his office shall be at all times open to examination by the President or Board of Trustees.
3. 04 VILLAGE ATTORNEY. (a) Appointment A Village Attorney shall be appointed by the President by and with the consent of the Board of Trástees.
(b} Qualifications No person shall be appointed Village Attorney who is not a bona fide resident and voter of McLean County and the State of Illinois. He need not be a resident of the village, but shall be a regularly licensed attorney of this state.
(c) General Duties The Village Attorney shall, on behalf of the village, when so requested by the President or the Board of Trustees, prosecute or defend in court all cases in which the interests of the village or officers there of are involved. He shall be furnished and supplied by the Clerk with certified copies of any ordinance, bond or paper in his keeping necessary to be filed or used in any suit or proceeding.
(d) Drafts of Orders The Village Attorney shall draft all such ordinances, resolutions, contracts, agreements and other papers as may be required of him by the President, the Board of Trustees, or any committees thereof. He shall be charged with the preparation of all ordinances pertain ing to local improvements, petitions and other legal papers pertaining thereto.
(e) Contracts and Deeds The Village Attorney shall draw all deeds, leases, contracts or other papers required by the business of the village when requested so to do by the President, the Board of Trustees or the head of any department of the village government.

Administration 3. 04
(1) Legal Opinions The Village Attorney shall when requested so to do furnish written opinions upon subjects transmitted to him by the President or upon a vote of the Board of Trustees.
(g) Compensation The Village Attorney shall be paid such compensation as is determined by the Board of Trustees. For work other than attend ance at regular village board meetings the Attorney shall be paid over and above his stated salary such compensation as may be agreed upon between himself and the Board of Trustees.
(h) Additional Counsel. The village may employ other counsel from time to time.
3. 05 HEALTH OFFICER. (a) Created Any member of the McLean County Board of Health may act as Health Officer for the village from time to time. The rules and regulations of the McLean County Office, as they apply to the area within the village limits, are hereby adopted.
(b) Duties The Health Officer shall exercise general supervision over the public health of the village and make diligent examination of all matters affecting the same.
3. 06 SUPERINTENDENT OF PUBLIC WORKS. (a) Created A Super intendent of Public Works shall be appointed by the President by and with the consent of the Board of Trustees.
3. 07 COLLECTOR. The Village Clerk shall hold the office of Village Collector. (See Supplement Added 12-5-94)
3. 08 OFFICERS AND EMPLOYEES. (a) Appointments The President with the consent of the Board of Trustees shall make appointments to fill all appointive offices. Employees of all departments shall be selected by the President in the absence of provision to the contrary.

3.07 Collector
The President at the first regular meeting in the month of May of each year shall appoint by and with the advice and consent of the Board of Trustees some competent citizen of the Village of Colfax as Collector for the ensuing fiscal year. Said citizen may be the same person appointed to the position of Village Clerk. (ref. IMC 3-7-1, 3-8-3).
THIS ORDINANCE shall take effect ten (10) days after passage and publication in pamphlet form under the authority of the Board of Trustees of the Village of Colfax, McLean County, illinois, as provided by law and shall convert the elected position of Village Collector into an appointed position. The current Village Collector shall serve out her elected tam but all subsequent Collectors shall be appointed as provided by this Ordinance.

(b) Terms of Office; Vacancies. Every appointive officer of the village shall hold office for a term of one year or until his successor is appointed and qualified unless it is otherwise provided by provision of this code. Employees selected shall serve so long as their services are desired.
(c) Assignment of Duties. The President shall have the power to assign to any appointive officer any duty which is not assigned by ordinance to some other specific officer and shall determine disputes or questions relating to the respective powers or duties of officers.
(d) Records. All records kept by any officer of the village shall be open to inspection by the President, or any member of the board, at all times whether or not such records are required to be kept by statute or provision of this code.
(e) Moneys Received. Every officer of the village shall at least once every day turn over all moneys received by him in his official capacity to the Clerk with a statement which shows the source from which the same was received.
(f) Oath. Every officer of the village shall, before entering upon his duties, take the oath prescribed by law.
(g) Bond. Every officer of the village shall, if required by the board. before entering upon the duties of his office, give a bond in such amount as may be determined by the board and with such sureties as it may approve, conditioned upon the faithful performance of the duties of his office or position.
(h} Salaries. All officers and employees of the village shall receive such salaries as may be provided from time to time by ordinance. No officer or employee receiving a salary from the village shall be entitled to retain any portion of any fees collected by him in the performance of his duties as municipal officer or employee in the absence of a specific ordinance provision to that effect.
(i) Arrests. The President and Trustees and members of the Police Department are hereby declared to be conservators of the peace with such powers to make arrests as are given to the conservators of the peace by the Illinois Statutes.
(j) Termination of Office Every officer of the village, upon the termination of his office, shall deliver to his successor all books and records. which may be the property of the village; and if no successor has been appointed within one week after the termination of office, such property shall be delivered either to the Clerk or to the Treasurer.

(k) Impersonation. It shall be unlawful for any person to impersonate without lawful authority any village officer or employee.
3.09 POLICE DEPARTMENT. (a) Created There is hereby created a Police Department of the village which shall consist of a Police Commissioner, a Chief of Police and such other members as the Board of Trustees may from time to time prescribe.
(b) Police Commissioner The Police Commissioner shall be appointed by the President and with the consent of the Board of Trustees. He shall be in charge of the Police Department and all members thereof shall be Subject to his orders. He shall make rules for the functioning of the Police Department subject to the approval of the Board of Trustees. He shall keep such records and make such reports of the activities of the Department as may be required by statute or ordinance. His office shall be considered part-time and his chief duties shall be to advise the Chief of Police and all other members of the Police Department.
(c) Chief of Police. The Chief of Police shall be appointed by the President by and with the consent of the Board of Trustees. The Chief of Police shall be in charge of all members of the Police Department other than the Police Commissioner, and they shall be subject to his orders.
(d) Duties. All other members of the Police Department, including Patrolmen, shall be appointed by the President by and with the consent of the Board of Trustees. They shall enforce the ordinances of the village and the laws of the state, effective in the village. They shall preserve order, prevent infractions of the law, and arrest violators of the law or ordinances of the village.
(Note: Village has entered into agreement with the County of McLean whereby the Sheriff of McLean County provides police services for the Village of Colfax for the period set forth in the agreement.)
3.10 MUNICIPAL AND FISCAL YEAR. The municipal year and the fiscal year of the Village of Colfax shall commence on May 1 of each year and end on April 30 of the following year.
3.11 VILLAGE SEAL. The corporate seal of the village shall be a circular disk containing the words "Village Seal" in the interior within a circle formed by the words, "Village of Colfax, McLean County, Illinois" around the outer circle, or a handwritten facsimile thereof.

WHEREAS, the President and the Board of Trustees of the Village of Colfax have fully considered the value of and need for retaining the Office of Village Administrator which was created by Ordinance No. 00-003, AN ORDINANCE SUPPLEMENTING CHAPTER 3 OF THE COLFAX MUNICIPAL CODE, and have determined that the Office of Village Administrator is unnecessary and was initially created without setting forth specific duties and responsibilities for a village administrator; and
WHEREAS, the President and the Board of Trustees of the Village of Colfax find, agree and hold the opinion that the continuation of the Office of Village Administrator is no longer necessary or in the best Interest of the Village of Colfax and that the said Office of Village Administrator should be discontinued.
BE IT ORDAINED BY THE PRESIDENT AND THE BOARD OF TRUSTEES OF THE VILLAGE OF Colfax, ILLINOIS:

WHEREAS, the President and the Board of Trustees of the Village of Colfax have reviewed Section 3.12 of Chapter 3 of the Municipal Code of the Village of Colfax, Mclean County, Illinois which states as follows:
WHEREAS 65 ILCS 5/3.1-30-21 requires any municipality which employs part-time police officers to establish hiring standards for part-time police officers and to submit those standards to the Illinois Law Enforcement Training Standards Board:
"3.12 HIRING STANDARDS FOR PART-TIME POLICE
OFFICERS.
Section 1: Hiring standards for part-time officers In the Village of Colfax, McLean County, Illinois are hereby established as follows:
A. Applicants shall be a minimum of twenty-one (21) years of age.
B. Applicants must possess a valid high school diploma or GED equivalent. Preference may be given to individuals with relevant additional education or experience.
C. Applicants must possess * valid Illinois driver's license and possess or be capable of obtaining a valid Illinois firearm's owners identification card.
D. Applicants must be of good moral character, not have been convicted of any felony offense, any act of domestic violence, or any crime involving dishonesty or moral turpitude.
E. Applicants mist be capable of completing all training required under the Intergovernmental Law Enforcement Officers Inservice Training Act, receiving certification under S8.2 of the Illinois Police Training Act and fulfilling any other requirements as may from time to time be imposed by applicable law.

F. Applicants must execute written waivers necessary to complete any required testing together with written waivers releasing any prior employer, any representative of any prior employer and any references from liability with respect to information provided to any representative of the Village during the hiring process.
G. Applicants must successfully complete or participate in any combination of the following, a written interview and/or an oral interview, a screening or background check, drug testing and any other type of check or review which the Police Committee of the Village Board and/or the Village Board deem appropriate.
Section 2. The Chief of Police is hereby authorized and directed to propose amendments to the manual of rules for the Police Department, which amendments are consistent with the standards hereinabove adopted and to submit those amendments to the Village Board for its review and consideration.
Section 3. A certified copy of this Ordinance shall be submitted to the Illinois Law Enforcement Training Standards Board as required by statute.
Section 4. This ordinance is hereby ordered to be published in pamphlet form by the Colfax Village Clerk and said Clerk is ordered to keep at least three (3) copies hereof available for public inspection in the future and in accordance with the Illinois Municipal Code.
Section 5. This Ordinance is in addition to all other ordinances on the subject, shall be construed therewith, excepting as to that part in direct conflict with any other ordinance, and in the event of such conflict, the provisions hereof shall govern.
Section 6. This Ordinance shall be in full force and effect from and after its passage, approval and ten (10) day period of publication in the manner provided by law.
And have detennined that said Section 3.12 should be rescinded and replaced with the following:

BE IT ORDAINED BY THE PRESIDENT AND THE BOARD OF TRUSTEES OF THE VILLAGE OF COLFAX, McLEAN COUNTY, ILLINOIS:
SECTION 1. That the Section 3.12 of Chapter 3 of the Municipal Code of the Village of Colfax, McLean County, Illinois which states as follows:
"3.12 HIRING STANDARDS FOR PART-TIME POLICE OFFICERS IN THE VILLAGE OF COLFAX.

Section 1. Hiring standards for part-time officers in the Village of Colfax are hereby established as follows:
A. Applicants shall be a minimum of twenty-one (21) years of age.
B. Applicants must possess a valid high school diploma or GED equivalent. Preference may be given to individuals with relevant additional education or experience.
C. Applicants must possess a valid illinois driver's license and possess or be capable of obtaining a valid Illinois firearm's owners identification card.
D. Applicants must be of good moral character, not have been convicted of any felony offense, any act of domestic violence or any crime involving dishonesty or moral turpitude.
E. Applicants must be capable of completing all training required under the Intergovernmental Law Enforcement Officers Inservice Training Act, receiving certification under S8.2 of the Illinois Police Training Act and fulfilling any other requirements as may from time to time be imposed by applicable law.
F. Applicants must execute written waivers necessary to complete any required testing together with written waivers releasing any prior employer, any representative of any prior employer and any references from liability with respect to information provided to any representative of the Village during the hiring process.
G. Applicants must successfully complete or participate in any combination of the following: a written interview and/or an oral interview, a screening or background check, drug testing and any other type of check or review which the Police Committee of the Village Board and/or the Village Board deem appropriate.
Section 2. The Chief of Police is hereby authorized and directed to propose amendments to the manual of rules for the Police Department, which amendments are consistent with the standards hereinabove adopted and to submit those amendments to the Village Board for its review and consideration.

Section 3. A certified copy of this Ordinance shall be submitted to the Illinois Law Enforcement Training Standards Board as required by statute.
Section 4. This ordinance is hereby ordered to be published In pamphlet form by the Colfax Village Clerk and said Clerk is ordered to keep at least three (3) copies hereof available for public inspection in the future and in accordance with the Illinois Municipal Code.
Section 5. This Ordinance is in addition to all other ordinances on the subject, shall be construed therewith, excepting as to that part in direct conflict with any other ordinance, and in the event of such conflict, the provisions hereof shall govern.
Section 6. This Ordinance shall be in full force and effect from and after its passage, approval and ten (10) day period of publication in the manner provided by law.
Is hereby rescinded and replaced with the following provision:
"3.13 HIRING STANDARDS FOR PART-TIME POLICE OFFICERS IN ThE VILLAGE OF COLFAX, McLEAN COUNTY, ILLINOIS.
SECTION 1. Hiring standards for part-time police officers in the Village of Colfax, McLean County, Illinois are hereby established as follows:
(a) Applicants shall be a minimum of twenty-one (21) years of age.
(b) Applicants must possess a valid high school diploma or CU) equivalent. Preference may be given to individuals with relevant additional education or experience.

4. Any other type of check or review which the Police Committee of the Village Board of Colfax and/or the Village Board of Colfax deems appropriate.
SECTION 2. The Chief of Police of the Village of Colfax Is hereby authorized and directed to propose amendments to the manual of rules for the Colfax Police Department, which amendments are consistent with the standards hereinabove adopted and to submit those amendments to the Village Board of Colfax for its review and consideration.
SECTION 3. A certified copy of this Ordinance shall be submitted to the Illinois Law Enforcement Training Standards Board as required by statute.

ORDINANCE NO. 2007-03
AN ORDINANCE AMENDING SECTION 4.01, 4.03, SECTION 4.04, AND 4.06 OF CHAPTER 4. MUNICIPAL PURCHASING. OF THE MUNICIPAL CODE OF THE VILLAGE OF COLFAX. McLEAN COUNTY. ILLINOIS
WHEREAS, the President and the Board of Trustees of the Village of Colfax have fully reviewed and considered the merits of amending Chapter 4, Municipal Purchasing, in accordance with the applicable limitations set forth in 65 ILCS 5/9-9-1 as amended; and
WHEREAS, the President and the Board of Trustees of the Village of Colfax believe that the modification of Chapter 4, Municipal Purchasing, by increasing the threshold limitation for competitive bidding from $4,000.00 to $20,000.00 for any work or other public improvement which is not to be paid for in whole or in part by special assessment or special taxation, affords the Village of Colfax the opportunity for the saving of funds which would otherwise be expended for employees and others time in securing bids and for the cost of advertisement of notice of letting of bids.
BE IT ORDAINED BY THE PRESIDENT AND THE BOARD OF TRUSTEES OF THE VILLAGE OF COLFAX, ILLINOIS, AS FOLLOWS:
Section 1. That Sections 4.01, 4.03, 4.04, and 4.06 of Chapter 4 (Municipal Purchasing) of the Municipal Code of the Village of Colfax, McLean County, Illinois are hereby deleted in their entirety; and
Section 2. Chapter 4 (Municipal Purchasing) of the Municipal Code of the Village of
Colfax, McLean County, I is hereby amending by adding thereto the following
Sections 4.01, 4.03, 4.04, and 4.06:
SECTION 4.01 COMPETITVE BIDS TO BE OBTAINED. Any work or other public improvement which is not to be paid for in whole or in part by special assessment or special taxation, when the expense thereof will exceed $20,000, shall be constructed either (1) by a contract let to the lowest responsible bidder after advertising for bids as in the manner described in Section 4.03 hereinafter, except that any such contract may be entered into by the proper officers without advertising for bids, if authorized by a vote of two-thirds of all the trustees then holding office; or (2) in the following manner, if authorized by a vote of two-thirds of all the trustees then holding office, to-wit: the Superintendent of Public Works or such other proper officers or department head as may be designated by ordinance shall superintend and cause to be carried out the construction of the work or other public improvement and shall employ exclusively for the performance of all manual labor thereon, laborers and artisans whom the municipality shall pay by the day or hour; and all material of the value of $20,000 and upward used in the construction of the work or other public improvement, shall be purchased by contract let to the lowest responsible bidder.  Nothing herein contained shall apply to any contract with the federal government or any agency thereof.

SECTION 4.03 PROCEDURES IN CONTRACTS OVER $20,000.00. (a) Publication. All proposals to award purchase orders or contracts in excess of $20,000 shall be published once at least 10 days in advance of the date announced for the receiving of bids, in a newspaper of general circulation throughout the village by the Clerk. Nothing herein shall be construed to prohibit the Clerk from posting additional notices or advertising in addition thereto in trade magazines, if so directed by the Board of Trustees.
(b) Advertisements for Bids. Advertisements for bids shall describe the character of the proposed contract, purchase or improvement in sufficient detail to enable the bidders thereon to know what their obligations will be, either in the advertisement itself, or by reference, to detailed plans and specifications on file in the office of the Clerk at the time of publication of the announcement. The advertisement shall also state the date, time and place assigned for the opening of bids, and such bids will be received at any time subsequent to the time indicated in the announcement.
(c) Deposit on Bids. Cash, a cashier's check, or a certified check as a deposit of good faith, in a reasonable amount but not in excess of 10 percent of the contract or purchase amount, may be required of each bidder on all sums in excess of $20,000 if specified in the bid announcement.
(c Opening of Sealed Bids. All sealed bids shall be publicly opened by the Board of Trustees. All bids shall be open to public inspection in the office of the Clerk.
(e) Bid Award. The award of any purchase or contract in excess of $20,000 shall be made by the Board of Trustees to the lowest or highest responsible bidder, depending on whether the village is to expend or receive money.
SECTION 4.04 EMERGENCY CONTRACTS. In the event of an emergency affecting the public health, welfare or safely so declared by the President, a contract may be let or purchase made, to the extent necessary to resolve such emergency without public advertisement in a sum not to exceed $20,000. The President shall file his authority for such expenditure in writing in the office of the Clerk and a copy to the Board of Trustees and shall provide the date or time when the emergency shall terminate and shall name the person authorized to make such expenditure or contract and the amount or amounts to be expended.
SECTION 4.06 CONTRACTS ON PURCHASES OF $50 TO $20,000.00. A village officer shall certify to the chairman of the purchasing committee of the Board of Trustees all requisitions or purchase orders or proposed contracts in the sum of $50 to $20,000 together with all necessary attachments thereto including written itemized statements, descriptions of transaction, quality, and all other data and information relative to the transaction, contract, purchase or lease to properly enable the chairman to approve or disapprove the request and shall thereafter present the committee's recommendations thereon to the board for concurrence or disapproval or such other action as may be required by law.  Approval by the board of an expenditure, contract, lease, or purchase shall empower the departmental head to enter into a contract to be executed by the President on behalf of the village or to make the purchase.  The approval or authorization by the board may provide such other terms, conditions, directions, or restrictions as may be require by the board.

SECTION 3. Excepting only for the amendments set forth above in sections 4.01, 4.03, 4.04, and 4.06 all other provisions of Chapter 4 (Municipal Purthasing) of the Municipal Code of the Village of Colfax, McLean County, Illinois shall remain in full force and effect.
SECTION 4. That this Ordinance, due to urgency, shall be in full force and effect from and after its passage and approval, in booklet form, according to the laws of the State of Illinois.

WHEREAS, the President and the Village Board of Trustees of the Village of Colfax has received the Plan of the Illinois Municipal League Risk Management Association including By-Laws, the Intergovernmental Cooperation Contract, and the anticipated cost of the participation in the Plan; and,
WHEREAS, THE Village Board finds it to be in the public interest of the Village to participate in the Plan.
NOW, THEREFORE, BE IT ORDAINED by the.President and the Board of Trustees of the Village of Colfax as follows:
1. That the Village Board does hereby authorize and approve membership in the Illinois Municipal League Risk Management Association and directs the president and clerk to execute an Intergovernmental Cooperation Contract with the Illinois Municipal League Risk Management Association for membership on an annual basis and each year thereafter unless this ordinance is repealed.
2. Each Member hereby agrees to contribute to the Association a sum of money to be determined by the Association at the time of its annual renewal based on the needs of the Association and the loss experience of the Member, which sum shall constitute the cost of the Member's contribution for membership in the Association.

3. That this Ordinance shall be effective immediately upon its passage and approval.

4. That this Ordinance shall be published in pamphlet form.
