CHAPTER 5
STREETS, ALLEYS AND SIDEWALKS

5.01 and 5.02 repealed by ordinance Adopted on 4.6.98
5.03 DAMAGE TO STREETS. No person shall damage or deface any street, alley, sidewalk, public way, park or other public property, or any post, wire, lamp, street sign, traffic sign, tree, grass, vegetation, gutter, drain, manhole or any other appurtenance thereon, except as maybe author ized by the village.
5.04 ENCROACHMENTS ON STREET. (a) No person shall erect or maintain any structure or thing on, over or under any street, alley, side walk or public way except by permit from the Board of Trustees. Applica tion for such permit shall describe the nature of the encroachment in such detail as the board shall require. The board in its discretion may issue or deny the permit, and may impose any conditions to such permit it deems appropriate.
(b) Awnings made of a pliable substance attached to a building and ex tending not less than 8 feet above the surface of the sidewalk may be erected and maintained without a permit.
(c) Any encroachment on any street, alley, sidewalk or public way shall be maintained so that it does not endanger or obstruct the public.
(d) Any encroachment maintained in violation of this section is declared a nuisance and may be abated by the village.
5.05 OBSTRUCTING STREETS. (a) No person shall obstruct or en danger the free passage or proper use of the public of any street, sidewalk, alley or public place, except as may be permitted by this chapter.

                                                                                                                                                            

CHAPTER 5 - STREETS, ALLEYS AND SIDEWALKS
5.01 NAMES OF STREETS
A. There is shall be a uniform system for street naming or renaming and for numbering property and buildings on all streets, lanes, roads, highways and public ways of the Village of Colfax.
B. All streets, lanes, roads, highways, and public ways in the Village of Colfax shall be known and designated by the names applied thereto, respectively, on the map of the Village kept on file in the office of the Village Clerk. The street names designated on such map shall continue to be the names of streets unless and until changed by ordinance of the Village Board. The naming of all such streets, lanes, roads, highways, and public ways shall be coordinated by the Village, the McLean County Emergency Telephone System Board, and the United States Postal Service.
C. Signs designating the names of public streets, lanes, roads, and highways shall be erected and maintained by the Village of Colfax.
D. Signs designating the names of private streets, lanes, roads, and highways shall be erected and maintained at the expense of the property owner or owners occupying such private streets, lanes, roads, and highways. Said signs shall be located to be easily visible to emergency personnel traveling from a public access road into the private roadway. All signs shall be of the same or similar construction as the signs erected by the Village of Colfax and shall be installed within ninety days of notification to the private property owner or owners.
5.02 (1) Numbering
A. All buildings shall be numbered in accordance with the provisions set forth herein. All numbers for property shall be assigned in a manner mutually agreed upon by the Village, the McLean County Emergency Telephone System Board, and the United States Postal Service.
B. Each house, building or other occupied structure shall be assigned a separate number. A number or alphabetical letter shall be assigned for each separate occupant (i.e. apartment, company, etc.) within a building or other occupied structure.
C. Existing numbers shall be changed only as necessaq to ensure the effectiveness and efficiency of the Enhanced 911 system in the Village of Colfax, as determined in the judgement of the McLean County Emergency Telephone System Board.
D. Written notification of the proper address of each house, building or structure shall be given to its owner, occupant or agent in all instances where a new number has been assigned under the terms or this ordinance.

(2) Placement of Numbers -
A. The owner, occupant or agent of each house, building or other structure thall be assigned a number under the uniform numbering system provided in this ordinance shall place or cause to be placed such number on or near house, building or other structure within 90 days after receiving notification of the proper number assignment.
B. Cost and installation of the numbers for the structures shall be paid for by the property owner. Numbers shall be not less than (3) inches in height. All numbers shall be made of durable and clearly visible material.
C. All numbers shall be conspicuously placed immediately above, on or at the side of the appropriate door to the house, building or other structure so that the number is clearly visible from the street. In cases where the structure is situated so that number s placed upon it cannot be clearly visible from the street, the structure number shall be placed near the walk, driveway, or common entrance to the structure and upon the mailbox, gatepost, fence or other appropriate place so as to be clearly visible from the street.
(3). PENALTY. Failure to place signs and/or numbering pursuant to this ordinance shall be deemed to be in violation of this ordinance. Any person who violates this ordinance shall upon conviction thereof be fined not less than $25 nor more than $200. A separate offense shall be deemed committed upon each day during or on which a violation occurs or continues.

ORDINANCE 2003-13
AN ORDINANCE RESCINDING AND REPLACING SECTION 5.01 AND 5.02 OF CHAPTER 5 OF THE MUNICIPAL CODE OF ThE VILLAGE OF COLFAX, McLEAN COUNTY, ILLINOIS
WHEREAS, the Village Board of Colfax, McLean County, Illinois has determined that to adequately provide public services to the residents of the Village of Colfax, including such services as police, fire and emergency medical services, and dispatching for such services through the McLean County Emergency Telephone System Board, it requires the establishment of a uniform street naming and numbering system for buildings and property located in the Village of Colfix; and
WHEREAS, the Village Board of Colfax further feels that the ordinance enacted herein will secure the public safety and deliver the aforementioned public services in a more efficient and effective manner;
WHEREAS, the President and the Board of Trustees of the Village of Colfax have reviewed Section 5.01 and 5.02 of Chapter 5 of the Municipal Code of the Village of Colfax, McLean County, illinois which states as follows:
"5.01 NAMES OF STREETS

Any person who violates this ordinance shall upon conviction thereof be fined not less than $25 nor more than $200. A separate offense shall be deemed committed upon each day during or on which a violation occurs or continues."
And have determined that said Section 5.01 and 5.02 of Chapter 5 should be rescinded and replaced with the following:

"5.01 NAMES OF STREETS

B. All streets, lanes, roads, highways, and public ways in the Village of Colfax shall be known and designated by the names applied thereto, respectively, on the map of the Village of Colfax kept on file in the office of the Village Clerk. The street names designated on such map shall continue to be the names of streets unless and until changed by ordinance by the Village Board of Colfax. C. Existing numbers shall be changed only as necessary to ensure the effectiveness and efficiency of the Enhanced 911 system in the Village of Colfax, as determined in the judgment of the McLean County Emergency Telephone System Board.

5.03 PENALTY
Failure of owner(s) to place signs and/or numbering pursuant to this Ordinance shall be deemed to be in violation of this Ordinance. Any person who violates this Ordinance shall upon conviction thereof be fined not less than $25.00 or more than $200.00 per day per violation. A separate offense shall be deemed committed upon each day during or on which a violation occurs or continues."

That this Ordinance, due to urgency, shall be in full force and effect from and after its passage and approval, in booklet (pamphlet) form, according to the laws of the State of Illinois.

Streets 5.05
(b) Goods, wares and merchandise may be placed on sidewalks for such reasonable time as may be necessary while loading and unloading, provided pedestrian traffic is not obstructed.
5.06 BUILDERS OCCUPYING STREET. (a) Permission Builders may occupy such portion of the public street and sidewalk abutting upon and adja cent to such buildings for private use in connection with the actual building operations under such permit as is required, subject to the supervision and direction of the Superintendent of Public Works.
(b} Materials on Streets. No materials except those required for immediate use in connection with a building or structure, or the alteration or repair thereof, shall be placed upon the street or sidewalk abutting upon or adjacent to such building. As soon as such building or structure is under roof, all materials shall be placed within the lot line, and the Street and sidewalk cleaned and placed in the same condition as before the beginning of building operations under such permit.
(c) Area Used; Temporary Walks. No more than one-half the space be tween the center line of the street and the lot line of the premises u?on which such building alterations or repairs are being conducted under such permit, and no more than one-third the width of any public sidewalk, shaU be occupied under such permit; provided the full width of the sidewalk may be occupied by the consent of the Superintendent of Public Works, and the providing of a temporary walk leading around the obstructed portion of the sidewalk connecting with the permanent walk at either end thereof. Such temporary walk shall be constructed to the satisfaction of the Superintendent of Public Works, and it shall be his duty to cause the same to be made safe and secure for public travel upon the same.
(d) Access to Hydrants, Drains No building material, temporary walk or obstruction shall be placed so as to render inaccessible access to, or obstruct any fire hydrant, manhole, catch basin, or vault, or render impassable to vehicles any street, alley or public way.
(e) Cleaning Walk. The holder of such permit shall at all times during the work thereunder, maintain the portion of the permanent sidewalk re served or the temporary walk above provided for, in a safe condition and clear of all material, rubbish, dirt or snow.
(f) Barriers. He shall erect and maintain a sufficient and suitable fence, railing or barricade to guard all excavations, embankments or obstructions along the street, obstructed during the time he shall occupy the same under such permit.

Streets 5. 06
(g) Lights. He shall place and maintain proper and sufficient red lights or tallow pots on each end of every such obstruction or excavation and at in tervals of 50 feet along the same at night. No person shall remove, extinguish or disturb the lights or pots.
(h) Obstructing Gutters. He shall at no time obstruct the gutter or waterway of any Street 50 as to prevent free passage of water along the street, and if any gutter be shaded or covered so that ice accumulated therein, he shall clear the gutter of such ice so as to allow the water to pass freely at all times.
5. 07 MATERIALS IN STREETS. (a) Any person not holding a building permit shall not store any materials on any street, sidewalk or public place without a permit therefor from the village.
(b) The fee for such permit shall be $10.
(c) The permittee shall conform to the provisions of Section 5.06 relating to builders occupying streets to the extent they are applicable, and to such other conditions as the village may impose when granting the permit.
5.08 EXCAVATIONS AND WORK IN STREETS. (a) Permit No person shall change the grade or level, or injure or tear up any pavement of any street, sidewalk, crosswalk or curb, or any part thereof, dig any hole, trench, ditch or drain in, or dig or remove any sod, stone, earth, sand or gravel from any street or public ground in the village without first obtaining a permit from the office of the Village Clerk as hereinafter provided. Be fore such permit shall issue, it shall first be approved by the Board of Trustees and, in the event that the permit is obtained for the purpose of making a connection to a sewer or water facility of the village located in any public street, the Superintendent of Public Works may, if practical, require the applicant to tunnel or auger instead of removing or injuring the pavement.
(b) Fee and Bond The fee for a permit required under this section is $10. The applicant shall also deposit a cash bond as follows:
1. For excavation on any primary streets (all plant-mix that sur faces) a $1000 cash bond.
Z. For excavation on secondary streets (all gravel, dirt and like surfaces) a $250 cash bond.
The bond shall guarantee the applicant faithful and prompt restoration of the excavated area in accordance with the provisions of the ordinances of the Village of Colfax and the maintenance thereof for a period of two years. All public utilities operating under a franchise with the village shall be exempt from the requirements of this subsection (b).
(c) Protection of Village. Any applicant using or excavating any por tion of any street pursuant to the issuance of a permit shall save and keep the village free, clear and harmless from any loss or liability on account of any accident or damages resulting from such excavation or work, and shall enter into a hold harmless agreement with the village to this effect at the time the permit is issued. The applicant shall fully remove all material. dirt and rubbish from the space so occupied, and restore such street to its original condition immediately upon the expiration of the period named in the permit.
(d) Repairing and Replacing Excavations. The person excavating in any street or public place shall, if required by the Superintendent of Public Works to do so. immediately upon completion of the work, and as fast as practicable during the accomplishment thereof, return the earth, ram and pack down the same as fast as practicable to a firm and solid bearing state and in a manner. if possible, that will entirely prevent any settling of such earth. Such work shall be done to the satisfaction of the superintendent and under his direction. The superintendent may adopt proper rules and regulations for such relaying and replacing of such pavements and material. The superintendent may relay all pavement caused by any street opening other than those openings specifi cally required to be relayed by others or by the Board of Trustees from time to time.
(e) Protected Excavations and Obstructions; Lights at Night. It shall be the duty of any person engaged in digging into or working upon a street or public place, or who places building materials on any street or public place, where such work if left exposed would be dangerous to pedestrians, to erect a fence, barricade or railing at such excavation or work in such manner as to prevent danger to pedestrians. It shall be the duty of such person to place suitable and sufficient lights upon such railing or fence at sunset in the even ing, and keep them burning through the night.
(1) Liability for Damages. Any person performing any of the work mentioned in this section shall be liable for any damage which may be occasioned to persons or property by reason of carelessness connected with the work.
(g) Village Excavations. Whenever a street or other public place is excavated by the village, the village shall erect and maintain the fencing and lights required by this section.
(h) Notice to Village. Whenever any public street is obstructed or rendered impassable for vehicles by an excavation therein, or by the occupation thereof by building materials, or by any house in the process of moving, the person so obstructing such street shall immediately notify the Village Clerk of the location of such excavation or other obstruction, and of any change therein from day to day, during the progress of the work causing such obstruction.
5.09 LAYING OF PIPE IN STREETS. (a) Permit. No sewer, water pipe, conduit pipe, gas pipe, wire or cable for conveying electric current nor any Street or alley pavement, sidewalk, or other like improvement shall be placed, laid or maintained in, under, or upon any street alley, sidewalk, easement of passage or public place, except improvements constructed under special assessment proceedings, unless a permit authorizing the same has been issued by the village.
(b) Location of Gas Pipes. Any gas pipes when placed in any public Street or alley shall be laid so that there will be no interference with sewers or water pipes, and before any pipes are laid, permission must be secured from the village and same must be placed in a portion of the street or alley as may be directed by the village.
(c) Map to be Filed. Every gas company that lays down gas pipes in any public street or alley shall make and.file with the Village Clerk an ac curate map showing the exact location of every line of pipe laid by it, which map shall be accessible for public inspection and shall be kept constantly revised to show any changes or additions.
5.10 MOVING STRUCTURES ON STREETS. No person shall move any building or structure on any street without a permit from the Superintendent of Public Works. The Superintendent of Public Works may issue the permit under such conditions as he may reasonably prescribe to protect the streets and village and private property and to minimize public inconvenience. He may require the permittee to execute a bond or insurance contract in behalf of the village in such amount as he deems appropriate conditioned that the permittee will comply with the conditions of the permit and indemnify the village against any damage caused to village or private property or any person by removal of the building or structure.
5.11 DEBRIS IN STREETS. (a) No person shall litter or deposit any foreign matter on any street, alley, sidewalk, park or public place, ex cept building materials and merchandise as permitted under this chapter, or as may be permitted by the Board of Trustees,
(b) Any person violating this section shall be liable for the cost of removal of the foreign matter in addition to the penalty provided for violation of this code.

5.12 PROTECTION OF WORK IN STREETS. Any person laying, or making an excavation in, or doing any work in any street, sidewalk or other public place shall maintain suitable barricades to prevent injury to any person or vehicle by reason of the work. Barricades shall be protected by suitable lights at night. Any defect in any pavement shall be barricaded to prevent injury. Any person maintaining any opening or excavation in any such place shall guard such opening or excavation while the same remains open, by proper barricades and lights. No person shall interfere with or disturb any barricades or lights lawfully placed to protect or make new pavement or excavation or opening in any street alley or sidewalk.
5.13 BARBED WIRE FENCES. No person shall maintain or construct any fence composed in whole or part of barbed wire, or with any similar materials designed to injure any person, or any wire charged with elec trical current, except to protect industrial property, in which case the barbed wire must be at least six feet above the sidewalk and extend Inward from the property line.
5.14 ADVERTISING ON STREETS. No person shall paint or post any signs or bills on any trees, poles or other structures in any street or on the surface of any street or sidewalk.
5.15 SNOW ON SIDEWALKS. The person occupying the ground floor of any building, the user of any lot without a structure thereon, and the owner of any vacant building or other premises shall remove the snow and ice accumulating on the abutting sidewalks within 24 hours after any snow fall has ceased. If snow or ice cannot be removed the surface shall be sanded or otherwise treated to lessen the hazard for pedestrians until the climate permits removal.
5.16 DRIVEWAYS. (a) Permit. No person shall construct a driveway across any sidewalk without first having obtained a permit therefor from the Board of Trustees.
(b} Fee. The fee for a driveway construction permit is $10.
(c) Specifications. Driveways across sidewalks shall be constructed in compliance with specifications which have been adopted by the Board of Trustees and which are on file in the office of the Clerk.
(a) Repair. The person maintaining a driveway shall keep it in good. repair at the place where it crosses the sidewalk and free from any obstruction or other openings.

5. 17 TREES. (a) Planting Permit. No person shall plant any tree or shrub in any street, parkway or other public place without first having secured a permit therefor. Application for such permit shall be made to the Clerk, and shall be referred by him to the Board of Trustees for approval.
(b) Removal Permit. No person shall remove or cut down any tree or shrub in any street, parkway or other public place without having first se cured a permit therefor. Application for such permit shall be made to the Clerk, and shall be referred by him to the Board of Trustees for approval.
(c) Injury. No person shall injure any tree or shrub planted in any street, parkway or public place.
(d) Advertisements or Notices. No person shall attach any sign, advertisement or notice to any tree or shrub in any street, parkway or public place.
(e) Dangerous. Trees Any tree orshrub which overhangs any sidewalk, street or other public place in the village in such a way as to impede or interfere with traffic or travel on such public place shall be trimmed by the owner of the abutting premises on which such trees or shrub grows so that the obstruction shall cease. Any limb of a tree which has become likely to fall on or across any public way or place shall be removed by the owner of the premises on which the tree grows or stands.
(f) Wires. No person shall attach any wire or rope to any tree without the permission of the Board of Trustees. Any person granted the right to maintain poles and wires in the streets, alleys or other public places in the village shall in the absence of provision in the franchise concerning the subject, keep such wires and poles free from and away from any trees or shrubs in such places so far as may be possible and shall keep all such trees and shrubs properly trimmed, subject to the supervision of the Superintendent of Public Works, to insure that injury shall not be done to the poles, wires, shrubs and trees by contact with wires.

ORDINANCE NO. 001-03
AN ORDINANCE AMENDING CHAPTER 5
OF THE COLFAX MUNICIPAL CODE
WHEREAS, it is believed that it is necessary to add to Chapter 5 of the Colfax Municipal Code of the Village of Colfax, McLean County, Illinois, passed, approved, and published January
5, 1976.
NOW THEREFORE, be it ordained by the President and Board of Trustees of the Village of Colfax, McLean County, Illinois, as follows:
THAT ChapterS of the Colfax Municipal Code of the Village of Colläx, McLean County, Illinois, passed, approved, and published January 5, 1976, be amended by adding the following:
5.18 DRIVEWAYS and DITCHES.
(a) General It shall be unlawful to:
(I) excavate, alter or disturb the shoulders, ditches, embankments, streets, roads or any surfaces improved for travel within the Village of Colfax without written permission from the Village. Excavation, alteration or restoration shall require that a contractor or resident obtain a bond! surety satisfactory to the Village unless waived by the Village.
(2) construct, disturb or alter in any way, any ditch, driveway, entrance, exit or approach within the limits of the right-of-way of any town highway, without an application and written permit issue by the Village of Colfax. Any such application shall describe the location of the work, extent of the work, and list any traffic control devices required. All work shall comply with Grades that adequately protect and promote highway drainage and permit a safe and controlled approach to the roadway in all seasons and will include any other terms and specifications necessary for the safety of the traveling public.
(b) Driveways
(1) Driveways shall be constructed such that the surface will slope smoothly from the edge of the pavement to a line 5 feet distant from the edge of such pavement. At that point the driveway shall be a minimum of 3 inches lower than the edge of the pavement.
(2) Driveway culverts within the right-of-way shall be a minimum of 8 inches in diameter and long enough to extend 3' beyond the driveway surface on both sides. Driveway culverts shall be installed so as to have a minimum of 12 inches of gravel on top and be at a depth so as not to dam runoff and must be at a minimum slope of 1/4 inch per foot.

(c) Ditches
(1) Ditches established by either the natural flow of water or dug to control the flow of water from rain/runoff shall be maintained by the property owner free of trash, leaves, brush, rubbish or other waste materials.
(2) Property owners shall have the obligation to construct and/or maintain a ditch or pipe or culvert line on their property adjacent to the streets in the Village so as to provide for the drainage of surface water in such a fashion as to keep the water from either eroding the base or foundation of the streets or flowing across or onto the streets.
(3) No man-made ditch shall lie so as to deposit liquid or solid matter on adjoining property without the approval of the adjoining property owner and without provision being made by the adjoining property owner to dispose of such.
(4) Materials used to line ditches or to control erosion must be stable so as not to be displaced. If material should be displaced onto adjoining property, the owner of the property from which the material was displaced shall remove the material from the adjoining property or streets within seventy-two hours of being notified of such.
(5) Property owners shall obtain a permit from the Village of Colfax to fill in or modify the invert or cross section of any ditch located within the Village right of way. Any pipe size and/or fill material shall not be installed or modified without first obtaining approval by the Village. Any such fill material shall be graded smooth to a point with a maximwn elevation of 3" below the edge of pavement when measured at a line located 8' parallel to and adjacent to the edge of the roadway. Culverts within the right-of-way shall be a minimum of 8 inches in diameter. My such work shall properly drain and not create any pooling or standing water on Village right of ways, or adjacent property.
(6) In the event that adjacent property owners make application to fill in the ditches on both sides of a property line, the owners shall install an inlet within 5' of the property line along the former ditch line. This inlet shall be situated such that the rim elevation of the inlet be a minimum of 5 inches lower than the adjacent edge of the street to facilitate drainage, and all right of way surface waters shall be directed to this inlet. This inlet shall, as a minimum, meet the requirements as set for by the Illinois Department of Transportation for an inlet type A, with a type 8 grate.
(e) PENALTY
My person who violates, neglects, refuses to comply with, or assists or participates in any way in the violation of any of the provisions or requirements of this Ordinance or of any of the provisions or requirements herein, upon conviction thereof, shall be fined not less than $50.00 nor more than $250.00 for each offense. Everyday an offense exists shall constitute a separate offense.

 

THIS ORDINANCE shall take effect ten (10) days after passage and publication under the authority of the Board of Trustees of the Village of'Colfax, McLean County, Illinois, as provided by law.

PERTAINING TO BILLING FOR WATER SERVICE
WHEREAS, the President and Board of Trustees of the Village of Colfax, McLean County, Illinois have reviewed the existing water rates for consumers within the Village of Colfax with both water and sewer services provided by the Village of Colfax, for consumers residing outside the Village of Colfax corporate limits with both water and sewer services provided by the Village of Colfax, and for consumers residing outside the Village of Colfax corporate limits with water service only provided by the Village of Colfax, and have deemed it appropriate and necessary to modify the rates for water usage for the purpose of providing all such consumers with a quality water system now and in the future,
NOW THEREFORE BE IT ORDAINED by the President and Board of Trustees of the Village of Colfax, McLean County, Illinois as follows:
Section 1. Rescinding of Sections 6.09 (a) 2,6.09(b) 2. and 609(c) 2 That Sections 6.09 (a) 2, 6.09 (b) 2 and 6.09 (c) 2 of Chapter 6 (Water System) of the Municipal Code of the Village of Colfax, McLean County, Illinois are hereby rescinded as to the rates for water usage as set forth under said Sections 6.09 (a) 2, 6.09 (b) 2 and 6.09 (c ) 2 of Chapter 6 of the Municipal Code of the Village of Colfax, McLean County, Illinois thereof for water usage commencing on or after midnight on December 31, 2008 but shall specifically remain in full force and effect for all water services provided, usage of water, and billings for such water service and usage through midnight on December 31, 2008.
Section 2. Amendment of Chapter 6 by the Replacement and Addition to Chapter 6 of new Sections 6.09 (a) 2. 6.09 Ib) 2. and 609 Ic) 2 That Chapter 6 (Water System) is hereby amended by the replacement and addition of Sections 6.09 (a) 2, 6.09 (b) 2 and 6.09 (c) 2 of Chapter 6 (Water System) of the Municipal Code of the Village of Colfax, McLean County, Illinois as follows:
Section 6.09 (a) 2. For 1001 gallons or more of metered water per month, the monthly charge for water shall be $6.25 for the first 1000 gallons and 70 cents for each 100 gallons in excess of the first 1000 gallons.
Section 6.09 (b) 2. For 1001 gallons or more of metered water per month, the monthly charge for water shall be $7.25 for the first 1000 gallons and 70 cents for each 100 gallons in excess of the first 1000 gallons.

Section 6.09 (c) 2. For 1001 gallons or more of metered water per month, the monthly charge for water shall be $8.25 for the first 1000 gallons and 70 cents for each 100 gallons in excess of the first 1000 gallons.
Section 3. Effective date of water rate changes The rates for water supplied through meters as per the water rates established by this amendment of Chapter 6 (Water System), Sections 6.09 (a) 2, 6.09 (b) 2 and 6.09 (c) 2 shall be in full force and effect for all water services provided, usage of water, and billings for service and usage commencing on January 1, 2009 and thereafter.
Section 4. Severabilility. The provisions and sections of this ordinance shall be deemed separable and the invalidity of any portion of this ordinance shall not affect the validity of the remainder.
Section 5. Effective Date. That this Ordinance shall be in full force and effect from and after its passage, approval, and publication in booklet form, as provided by the laws of the State of Illinois.
